أهمیّة المقاصد الشّرعیّة فی ضروب الاجتهاد المُعاصر الاجتهاد الإنشائی والانتقائی نموذجا دراسة أصولیّة

Abstract

تحظى المقاصد الشّرعية بأهميّة بالغة ومکانة عظيمة في صدور أهل العلم من الفقهاء والأصولييّن، وقد بدى ذلک بصورة واضحة في عباراتهم، في حالات التّنزيل والتّخريج والاستنباط الفقهي، بما لا يدعُ مجالا للشّکّ على اهتمامهم بها، کونها حاضرة في أذهانهم عند النّظر في المُستجدّات والنوازل، وخاصّة في هذا العصر، الذي تشعّبت به الفروع وتکاثرت به الصّور للجزئيّات الفقهيّة بشکل لم يکن متصوّرا عند علماء الفقه المتقدمين –رحمهمالله -. من هنا هذا جاء البحث والذي يسعى إلى بيان المقاصد الشّرعيّة عند علماء الإسلام، وخاصّة مجالات المقاصد الشّرعية التي تدخل في باب الاجتهاد الفقهي. ولقد ناقش الباحث: أبرز ضروب الاجتهاد المُعاصر کالاجتهاد الإنشائي والانتقائي، وتحدّث عن أهمّيّة المقاصد الشّرعيّة في هذين الضّربين المُهمين، والتي برزت في معظم المراحل الاجتهاديّة بشکل واضح، وذلک في التّنظير والتّطبيق، وأسأل الله أن يجعل بحثي من العلم النّافع، والحمد لله رب العالمين.
