Abstract
This relatively unknown and seldom cited text by the great American institutional economist John R. Commons if of interest not merely because of the issues mentioned in its title. It also illuminates Commons's analysis of custom, law, and the state. This introduction gives some biographical details and discusses some of the important features of this essay.Keywords
