Abstract:
The article is devoted to some legal aspects of the development of gastronomic tourism in Ukraine. It provides analysis on the condition and prospects of legislative support for the development of gastronomic tourism in Ukraine. It provides research on the peculiarities of providing services in the field of gastronomic tourism by private farms. The problem of legal regulation of registration of facilities for the production and / or circulation of food by persons who provide food to tourists is raised. It is concluded that the provisions of the Law of Ukraine «On Basic Principles and Requirements for Food Safety and Quality» regarding the registration of such facilities do not apply to owners of personal farms. Abstract:
The article examines the features of administrative liability for violation of the organization and conduct of examinations in Ukraine. It is determined that the organization and conduct of the examination usually does not require the involvement of a wide range of persons. However, it should be noted that the concept of expertise is not always limited to forensic examination, which is usually appointed on the basis of a relevant court decision or other authorized body. It was found that the general procedure for organizing and conducting examinations is defined at the level of a significant number of regulations and bylaws. Such legislation establishes the requirements for experts, the stated conclusions of the examination, the rights and responsibilities of experts, as well as the responsibility for violating the procedure for conducting examinations. However, the current Code of Ukraine on Administrative Offenses does not contain any administrative law on administrative liability for violation of the procedure for conducting examinations in Ukraine. Therefore, there is a need for such a study. It is concluded that the priority actions to improve the institution of administrative liability for violation of the procedure for conducting and organizing examinations should be: first, the sphere of organization and conduct of non-judicial examinations needs legislative regulation; secondly, given that the current Code of Ukraine on Administrative Offenses does not contain any administrative law concerning liability for violation of the organization and conduct of examinations of both judicial and non-judicial, it is necessary to supplement the current Code of Administrative Offenses. 185-16, the following content, namely Violation of the order of organization and conduct of examinations, persons who are entrusted with the authority to organize and conduct examinations entails a fine of one hundred to two hundred non-taxable minimum incomes. Abstract:
The article analyzes the current state of legal support for assessing the suitability of land for organic agricultural production. It is determined that in contrast to the previous legislation in the field of organic production, circulation and labeling of organic products, the current Law of Ukraine «On basic principles and requirements for organic production, circulation and labeling of organic products» from 10.07.2018 № 2496-VIII does not provide assessment of the suitability of agricultural land for the production of organic products. There are no requirements for such an assessment in the bylaws governing this area of public relations. It has been established that one of the primary steps towards regulating the process of valuation of agricultural land for organic production should be the introduction of mandatory agrochemical certification of land on which organic crop production is planned. Because it is agrochemical certification of agricultural land is one of the basic measures to determine the quality of soil composition. It is proposed, in order to operate with up-to-date data, to determine the terms of agrochemical certification of such lands not later than one year before the application for certification of organic production. For what proposals are put forward to make additions to: h. 5 Art. 37 of the Law of Ukraine «On Land Protection»; paragraph 3 of the Procedure for certification of organic production and / or circulation of organic products, approved by the resolution of the Cabinet of Ministers of Ukraine dated 21.10.2020 № 1032; p.p. 1.5 and 1.6 of the Procedure for maintaining the agrochemical passport of the field, land, approved by the order of the Ministry of Agrarian Policy and Food of Ukraine dated 11.10.2011 № 536. The proposed innovations will allow to objectively assess the quality of such lands and will guarantee the production of organic crop products. Abstract:
У статті проаналізовано запропонований до обговорення новий Кримінальний кодекс України. Зосереджено увагу на напрямках реформування системи кримінальної юстиції. З’ясовано, що запропонований до розгляду ККУ спрямований на захист інтересів потерпілих, передбачено, що він має бути зручним у користуванні. У проекті зафіксовано, що новий Кримінальний кодекс та його застосування мають відповідати рішенням Європейського суду з прав людини щодо України. Встановлено, що в проекті ККУ передбачена відповідальність для посадовців за невиконання рішень ЄСПЛ. У результаті аналізу перспективного законодавства з питань кримінальної відповідальності зроблено висновок про обрання правильного вектору реалізації основної ідеї нового КК – забезпечення справедливості у сфері кримінальної юстиції на нових засадах, класифікації правопорушень виходячи з виду заподіяної шкоди та встановлення типових санкцій, визначення співвідношення між тяжкістю кримінальних правопорушень за об’єктивним критерієм, уніфікація обставин, які підвищують або знижують ступінь тяжкості, ліквідація прогалин. Abstract:
Розглянуто питання правового регулювання інформаційного забезпечення про ґрунти. Надається характеристика великомасштабним дослідженням ґрунтів в Україні, які були проведені впродовж 1957–1961 рр. Встановлено причини не відповідності наявної інформації щодо структури і стану ґрунтового покриву. Обґрунтовано, що дані оцінки впливу на довкілля екологічного моніторингу, обстеження ґрунтів, кадастрової документації, інших можуть бути джерелами екологічної інформації. На основі проведеного правового аналізу зроблено висновок, що в проекті закону України «Про збереження ґрунтів та охорону їх родючості» необхідно закріпити, що документована інформація про стан ґрунтів та здійснювані заходи щодо охорони ґрунтів має бути відкритою, загальнодоступною, оскільки є такою, що становить суспільний інтерес, за винятком інформації, яку зачислено до категорії інформації з обмеженим доступом. Abstract:
У статті наданий аналіз можливості посилання сепаратистськими утвореннями в Україні на принцип самовизначення народів, як обґрунтування своєї діяльності. Розглянуті мінімально необхідні критерії правових підстав для самовизначення, серед яких: наявність ефективного зв’язку суб’єкта самовизначення із певною територією; наявність самого суб’єкту тобто народу (етносу), який претендує на самовизначення; і визнання міжнародним співтовариством такого потенційного суб’єкта носієм права на самовизначення. Щодо зв’язку з територією в доктрині міжнародного права і практиці за будь-яким етносом визнається право на культурно-національне самовизначення на певній території. Це право обмежується загальними інтересами всього народу держави, який полягає в безумовному збереженні недоторканності й цілісності її території. Щодо наявності самого суб’єкта самовизначення, то народом визнається історична спільність людей, яка склалася на певній території та володіє стабільними особливостями мови, культури і психічного складу (ментальність), а також усвідомленням своєї єдності і відмінності від інших через свідому самоназву. Водночас діаспори та мігранти мають підпорядковуватися законам країни проживання на праві громадянства чи праві постійного проживання. Щодо визнання суб’єкта самовизначення міжнародним співтовариством, то ними визнаються ті, що перебувають під колоніальним пануванням, окупацією іноземною державою чи щодо яких проводиться політика расизму. Отже, міжнародне право не захищає сепаратистські рухи, метою яких є сецесія, якщо вони не відповідають цим ознакам. Це означає, що сепаратистські утворення в Україні не мають права на сецесію, а за методами діяльності є терористичними організаціями. Abstract:
The article is devoted to the study of scientific approaches to the characteristics of the objects of natural resource relations. Theoretical positions of the representatives of legal science on the definition of the concept of natural resources as objects of natural resource legal relations, the separation of their legal features are revealed. Scientific approaches to the legal nature of climatic resources and their place in the modern system of natural resource legal relations are analyzed. Natural resource relations consist of the use and reproduction of natural resources or their properties (for example, the potential energy of water, which is converted into electricity, water surface for water transport, the properties of atmospheric air to contain and dissolve (reduce concentration) pollutants, the property of subsoil underground gas storage facilities, etc.). Climatic resources are called inexhaustible natural resources, which include solar energy, moisture, wind energy, etc. and are determined by the peculiarities of the climate. The use of certain properties of climatic resources as, first of all, alternative energy sources is extremely important. Climatic resources in most of Ukraine are favorable for the development of alternative energy. However, the current state of legal regulation of activities aimed at ensuring the rational and efficient use of climate resources needs to be improved. Abstract:
In the process of building the rule of law, one of its most important criteria is the creation of a fair, transparent and efficient judiciary. The essential need for radical changes in the judiciary and the reform of its individual institutions is a matter of time. The main goal of judicial reform in Ukraine should be to create legislative and organizational conditions for the establishment of an independent, efficient and accountable judiciary in Ukraine, which will be trusted by society. Judicial and legal reform in Ukraine is comprehensive and involves amendments to the Constitution of Ukraine, legislation on the judiciary and the status of judges, reform of related institutions (prosecutor's office, bar, law enforcement agencies), as well as improving procedural legislation and legislation governing enforcement. court decisions. Abstract:
In recent years, Ukraine has received not only new legislation, a new regulator, but also a new National Intellectual Property Authority. On the initiative of the Ministry of Economy of Ukraine, the Cabinet of Ministers of Ukraine 13.10.2020 № 1267-r, in pursuance of subparagraph 1 of paragraph 7 of section II «Final and transitional provisions» of the Law of Ukraine of 16.06.2020 № 703-IX «On Amendments to Certain Laws of Ukraine on the Establishment of a National Intellectual Property Authority» determined that the state enterprise «Ukrainian Institute of Intellectual Property» performs the functions of the National Intellectual Property Authority. Given that the state structures considered six options for the formation of a new national body, the definition of a temporary state enterprise «Ukrainian Institute of Intellectual Property» as the National Intellectual Property Authority, on the one hand was the best solution, and on the other, the intellectual property protection system to some laws of Ukraine on the establishment of a national intellectual property body, has undergone significant changes, which could not affect the entire system of intellectual property protection in the state. Abstract:
У статті піднято питання про потребу введення в юридичний обіг терміну «екологічний облік», який в економічних науках існує з 70-х років ХХ століття, а в еколого-правовій науці – під назвою «державний облік в галузі навколишнього природного середовища». Що стосується вітчизняного законодавства, то в ньому відсутня об’єднуюча для багатьох видів кадастрів, реєстрів, регістрів, звітів та ін. відомостей екологічного характеру назва. Встановлено, що в системі вітчизняного законодавства правовому регулюванню, в рамках окресленої тематики, підлягають кадастри природних ресурсів, облік шкідливих для навколишнього природного середовища об’єктів, облік шкідливих для навколишнього природного середовища речовин, а також фактори шкідливого впливу на навколишнє природне середовище (хімічні, фізичні, біологічні). Нажаль, багато з таких облікових даних є закритими, неповними або взагалі відсутні. В той-же час, на міжнародному та європейському рівні ці процеси стрімко розвиваються і сьогодні вже відзначається потреба у розширенні таких даних, шляхом включення у відповідні облікові ресурси інформації і про видані дозволи на використання природних ресурсів, сплату екологічних платежів, штрафів, виготовлення екологічно безпечної продукції і т. ін. На підставі цього висувається пропозиція про потребу систематизації вітчизняного законодавства про екологічний облік, шляхом розробки і прийняття спеціального нормативно-правового акту, який би відповідав міжнародним та європейським вимогам у цій сфері. Виноситься також пропозиція щодо потреби у трансформації положень статей 23 та 24 Закону України «Про охорону навколишнього природного середовища» шляхом їх об’єднання та розширення змісту, включенням усіх видів екологічного обліку. З’ясовано, що Україна вже розпочала процеси адаптації законодавства з цього питання, зокрема, шляхом встановлення вимог цифровізації усіх екологічних даних, тобто створення єдиної екологічної електронної платформи, яка сьогодні знаходиться лише на початку свого формування. Abstract:
В реаліях сьогодення питання протидії та запобіганню домашньому насильству має вкрай важливе значення, оскільки велика кількість жінок та дітей стають жертвами такого насильства, хоча трапляються випадки домашнього насильства і щодо чоловіків. У даній роботі було розглянуто питання щодо проблематики ролі органів прокуратури в запобіганні та протидії домашньому насильству. Також досліджено проблеми законодавчого врегулювання прокурорської діяльності в системі запобігання та протидії домашньому насильству. В процесі написання роботи було застосовано метод аналізу та синтезу, емпіричний метод та метод порівняння. І, дійсно, вірно підмічено в темі цієї статті, що це є все ж таки проблемою. В першу чергу через те, що нормами діючого законодавства чітко не врегульовано якими ж діями прокурори можуть запобігати чи протидіяти домашньому насильству, адже в їх повноваження входить безпосередньо процесуальний супровід таких кримінальних справ, тобто після того як таке насильство вже відбулось. На нашу думку, щоб органи прокуратури могли ефективно запобігати та протидіяти домашньому насильству пропонуємо внести зміни у статтю 131-1 Конституції України, яка визначає функції прокуратури в цілому, та прокурора зокрема. Доцільним вбачається доповнити цю статтю частиною, яка б надавала право органам прокуратури здійснювати превентивні заходи щодо запобігання та протидії домашньому насильству. Дослідження, проведені в даній роботі, можуть лягти в основу законотворчої діяльності при прийнятті змін до законодавчих актів, які регулюють правовідносини в сфері запобігання та протидії домашньому насильству. Abstract:
Agricultural insurance is a prerequisite for the existence of agriculture, especially for agricultural countries. The present time poses serious climatic, economic, and biological challenges to agricultural production. Insurance should become a tool that will help to balance the risks between all participants in agricultural insurance relations. Insurance should reduce the negative impact on agricultural production and living standards in the country. In the article on the basis of analysis of normative-legal acts, regulating the procedure of agricultural animals insurance the problematic issues are investigated and the ways of elimination of collisions in legal regulation of this type of insurance are offered. The problems of determining the list of animals subject to compulsory insurance are investigated and solutions are proposed. The question of legal expansion of the range of insurance risks for insurance contracts of animals in the framework of the Law of Ukraine «On peculiarities of insurance of agricultural products with state support» is analyzed. The proposed additions to the regulatory and legal acts in the field of insurance of breeding animals will lead to the harmonization of relevant legislation, as well as improve awareness of breeding animals for regulatory authorities, consumers of relevant products and insurers. Abstract:
Статтю присвячено аналізу окремих проблем організаційно-правових форм господарювання в аграрній сфері. Визначено основні тенденції розвитку організаційно-правових форм України в аспекті дерегуляції підприємницької діяльності та відкриття ринку земель сільськогосподарського призначення. Висвітлено роль та значення, види, законодавчі та доктринальні підходи до визначення організаційно-правової форми аграрного виробництва. На підставі аналізу юридичної літератури, національного законодавства та практики його застосування проаналізовано проблеми окремих організаційно-правових форм ведення аграрного виробництва (фермерських господарств, колективних сільськогосподарських підприємств та ін.). Зроблено висновок, що в Україні порушується принцип рівності форм власності та господарювання у сільському господарстві. Abstract:
The article explores the features of the legal regulation of bioenergy in the European Union, analyses the concepts of bioenergy and biofuels in Ukrainian and European legislation and highlights the main provisions of the European Union Directives, concerning the promotion of the use of energy from renewable sources, including biomass. In particular, bioenergy has been identified in the EU as the leading source of renewable energy for heating and cooling (88 per cent of all RES), representing 16 per cent of the total European final energy consumption in this sector. Consequently, in view of the demand for and the need to use such a resource, the EU legislative framework contains a number of principles (bases) and mandates for regulating the relationship in the area of manufacturing, handling and decontamination of waste biofuels as a primary feedstock for bioenergy. In particular, the fundamental principles of the EU bioenergy legislation are, first, the principle of sustainable production and consumption of biomass, and second, the prevention of reduction of negative impacts from the use of this resource, Third, increasing the share of alternative energy sources to 75 % of final energy consumption by 2050. Abstract:
Due to global warming, over-regulation of water bodies, disruption of water runoff, poor functioning or complete lack of drainage systems, reduction of forest areas, our state will not avoid the problems associated with flooding. The harmful effects of water are due to global factors, such as warming and melting glaciers, as well as regional features, including the water exchange system between water bodies, changes in rainfall and river runoff. Land flooding is a phenomenon that cannot be completely prevented. However, human activity increases its likelihood and impact. The risk of flooding and the degree of damage caused, as well as the impact on the health and socio-economic situation of those affected, will continue to increase in the future due to climate change. Inadequate river management, construction in flood-prone areas and the growing population living in these areas exacerbate the effects of flooding. Ukraine has already taken appropriate steps to implement the provisions of international acts in the field of preventing and combating land flooding into national legislation. However, the quality of implementation of national programs in this area requires better, as most measures, unfortunately, are not implemented. Failure to implement measures in certain amounts creates high risks of flooding, as a result of which the population and the economy of the state suffer multimillion losses. Abstract:
In the article considered guarantees of the right on access to ecological information fixed in international legal documents. Also made a research on state of implementation such international instruments in national Ukrainian legislation, separate legal instruments of realization the right to get ecological information. Made examples of successful defence of the broken right on access to ecological information. In order to exercise the right to information, it is important not only to have the norms enshrined in the legislation, but also the system of guarantees and opportunities for their implementation, which should be provided by public authorities. International legal documents establish only general approaches to the protection of rights, and their further development and consolidation is undoubtedly entrusted to national authorities. The analysis of the current national legislation allows to state that in general the international legal norms have found the reflection in national regulatory legal acts. However, over time, approaches to understanding environmental information, expanding its list, the subjects who have the right to receive it, so work in this direction should continue in order to increase the possibility of exercising the right of access to such information. Abstract:
Intellectual property rights are enshrined in the Universal Declaration of Human Rights. A patent for an animal breed is the exclusive right of the inventor to his selection achievement, it is a legal monopoly provided by the state, and patent protection prevents commercial use without the consent of its owner. Today's challenges are directly related to food security. The practical application of breeding achievements in animal husbandry, in particular, is the genetic improvement of animals from the «economic side», which directly affects the level of investment and rewards for breeders, and thus the need for effective legal protection of intellectual property rights. Based on the analysis of normative legal acts regulating the procedure for obtaining legal protection of selection achievements in animal husbandry, the article examines problematic positions and suggests ways to resolve conflicts in the legal regulation of these issues. The methods of our study were chosen taking into account the purpose and objectives of the study. The study used philosophical, general scientific and special legal methods of scientific knowledge. Abstract:
The right to go to court, including administrative, is one of the most important rights of citizens guaranteed by the Constitution and laws of Ukraine. In addition to the general constitutional right to judicial protection, in particular, Art. 7 of the Law of Ukraine «On the Judiciary and the Status of Judges» of 02.06.2016 № 1402-VIII, guarantees everyone the protection of his rights, freedoms and interests within a reasonable time by an independent, impartial and fair court established by law. Foreigners, stateless persons and foreign legal entities have the right to judicial protection in Ukraine on an equal footing with citizens and legal entities of Ukraine. Access to justice for every person is ensured in accordance with the Constitution of Ukraine and in the manner prescribed by the laws of Ukraine. However, along with the guaranteed right to apply to the court of foreigners, stateless persons (refugees, migrants, immigrants), such a category of subjects of administrative proceedings as apartheid remained outside the scope of domestic law. In order to eliminate the shortcomings of the legislative regulation of the legal status of apartheid in Ukraine, the author came to the conclusion that it is necessary to eliminate the existing shortcoming by amending the Law of Ukraine «On Legal Status of Foreigners and Stateless Persons» of 22.09.2011 № 3773-V. Abstract:
The scientific work investigates the features of administrative liability for offenses in the field of environmental protection. A classification of administrative offenses in the field of environmental protection has been formed, where the most common method is classification by object of encroachment. A study of the composition of administrative offenses in the field of environmental protection. In particular, it is determined that the composition of environmental offenses consists of: object – public relations in the field of environmental protection; subject – a natural sane person aged 16 years; objective side – illegal behavior, causing harm to the environment or violation of legal rights of subjects of environmental law; the causal link between the wrongful conduct of a person and the harm caused, the subjective side – guilt, motive and purpose of the offense. The issues, essence, features and types of measures of administrative coercion in the field of nature protection, the system and types of administrative penalties, the causes and conditions of committing offenses in the field of ecology are studied. In particular, it is determined that the causes and conditions of environmental offenses can be divided into two groups: subjective (is circumstances that arise in a person's desire to commit them) and objective, which include negative consequences for the nature of some achievements of science and technology. In addition, the scientific article attempts to analyze the main mechanisms of prevention of administrative offenses in this area and on the basis of this analysis, the authors provide their own conclusions on improving the administrative and legal mechanism of environmental protection. Also, it is determined that the administrative remedies for the prevention of administrative offenses in the field of environmental protection in addition to the establishment of legal norms, rules, regulations and standards include: state control over environmental protection; persuasion measures; measures of administrative coercion applied for the purpose of prevention, cessation of offenses in the field of environmental protection and bringing the perpetrators to administrative responsibility, as well as remedial measures. It is proved that to improve the administrative and legal mechanism in the field of ecology, our state should introduce: the use of legal, scientifically sound approach, a system of assistance to enterprises in the field of environmental modernization of production, adoption of the «polluter pays» principle, training and retraining of civil servants, environmental sphere. Abstract:
The scientific article examines the experience of the legal regulation of ecotourism in Poland. Poland is Ukraine's western neighbor and has passed the European integration path, so the application of Poland's positive experience in legal regulation of natural resources for ecotourism will be really useful. In particular, special attention is paid to the issues of clear delineation of the concept of ecotourism (rural green tourism), the purpose of ecotourism is determined. This scientific article directly analyzes the Polish legislation and identifies the main criteria that distinguish ecological / rural green tourism from other types of tourism. In general, it is determined that the experience of Poland in the legal regulation of ecotourism and its use of natural resources for ecotourism is quite progressive, as Polish legislation contains a number of provisions that address various issues that are not regulated in Ukraine. This scientific article highlights some aspects of the legal regulation of ecotourism (rural green tourism) in Poland, which may be useful for Ukraine. This scientific article presents proposals that can be tested by the domestic legislator in the process of formulating legislation on the use of natural resources for ecotourism. Abstract:
The goals of sustainable development, outlined in the final document of the UN Summit «Transforming our world: the 2030 agenda for sustainable development», continue to be the main model of development for all countries. Sustainable development is formed and provided by various determinants, among which legal values are not the last. They provide legal identification of objects recognized as benchmarking guidelines for sustainable development, and form the value and legal orientations of entities which activities are aimed at performing these tasks. The lack of a common system of legal values leads to the deformation of the legal consciousness of the population, the dominance of nihilistic trends, makes it impossible to achieve sustainability and stability in society. Therefore, the existence of a single value-legal paradigm is a consolidating factor of Ukrainian society, forms a positive attitude of the subjects to the political and legal life of the country, promotes their legal socialization and the development of a proper legal position. This allows to achieve social justice, build the foundations of inclusive development, ensure the rule of law, eradicate corruption and restore trust in the state and its institutions, strengthen social cohesion, ensure the interaction of public authorities with the public and self-organize the activities of citizens. Abstract:
The article draws attention to the little-studied field of historical and legal science, which is the question of the origin, formation and development of the science of land law in Ukraine. The relevance of this area of research from the point of view of the possibility of finding already existing in the past options for solving modern land law problems is emphasized. It is stated that the presented article makes it possible to achieve at least two tasks, the first of which is the analysis of theoretical views on the problems of land law of Kharkiv jurists of the 1920s, and the second – the introduction of little-known scientific papers on this issue, which allows to reproduce contemporary legal research in the field of land law. The scientific achievements of Kharkiv scientists, which are L.S. Dubinsky, O.L. Malitsky, M.F. Matvievsky, O.M. Odarchenko, S.E. Sabinin. Most of their scientific works are little known in both historical and legal and land law sciences. The analysis of the presented publications is an important basis for the conclusion about the existence in the 1920s of the Kharkiv center of the science of land law, which became the basis for the further formation of the relevant scientific school. Abstract:
The article emphasizes that the health of the population, which is one of the greatest values, is a necessary condition for socio-economic development of the country and emphasizes that in the fight against acute respiratory disease COVID-19, vaccination of the population of Ukraine is important. The legal acts are analyzed, the problematic issues related to vaccination of the population are revealed. One of the reasons for mistrust is the spread of false information about vaccination. It is emphasized that the solution of the existing problems of vaccination puts before the state the need to take appropriate organizational and legal measures. Abstract:
The article is devoted to the study of the activities of public administration authorities in the field of legal waste handling. Normative legal acts are analyzed, scientific opinions on the important role of administrative authorities are presented, the role of administrative law in the researched sphere is emphasized. It is proved that the regulation of relations in the field of waste handling is impossible without a system of public administration entities, which in accordance with laws and other regulations, within their competence are designed to solve the tasks of the state. It is identified that in addition to the executive authorities, other subjects of administrative law that do not belong to public authorities can have certain administrative functions in the field of waste handling. They can be legal entities and collective entities that have the status of a legal entity. In some cases, regulations may provide for the involvement of individuals of private law to implement management functions in the field of waste handling. Abstract:
The features of the system of modern principles of agrarian law were considered in the article. Attention was drawn to the lack of unity and significant differences between individual author positions in formulating a system of such principles in both qualitative and quantitative aspects. The reason for this situation, which is the opposition of objective and subjective principles in the nature of the principles of agrarian law, has been revealed. The predominance of the subjective component leads to the diversity of the principles proposed by scientists, which should not be invented, but discovered. The inconsistency of the subjective vision of scientists with the objective nature of the principles causes the ineffectiveness of the norms that are a consequence of the implementation of such principles in the normative array. Insufficient level of disclosure of theoretical nuances of formation of principles of agrarian law leads to their identification with tasks of agrarian law as branch of law. It has been stated that most scholars introduce a two-level differentiation of the principles of agrarian law into general and branch (special) ones. Attention was sharpened in the absence of the principles of the intersectoral level in most of the systems proposed today, which leads to unnecessary duplication at the level of sectoral (special) principles. The identification of common law and constitutional principles used in the theory of agrarian law has been criticized. The introduction of a six-tier structure of the system of principles of agrarian law in terms of general (international and national), intersectoral, sectoral, sub-sectoral, institutional and sub-institutional principles was justified. Abstract:
The article is devoted to the separation of specific features of the internal and the external agrarian financial relations. It is proved that the peculiarities of the first group of legal relations are conditioned by the organizational and legal form of legal entities in which they arise, change and interrupt. These features are established in the legislation governing the legal status of these entities. In particular, it determines the procedure for the formation of property funds of agricultural enterprises, the distribution of financial results (profits) among the founders and participants (members) (for example, payment of dividends (in companies), dividends and patronage dividends (in agricultural cooperatives), also contributions to this fund. At the same time, enterprises accept internal documents on the basis of which such distribution is carried out. In addition, the procedure for exercising control over their financial and economic activities is regulated. The procedure of payments with members (participants) in case of termination of the business entity or withdrawal from its members (participants) is also specific. The opinion is substantiated that the peculiarities of external agrarian financial legal relations are caused, as a rule, by the nature of the business entity activity. Therefore, these relations are regulated by agrarian legislation in field of the state financial support of agriculture and rural social sphere; implementation of certain types of agricultural activities; insurance and lending of the agricultural producers. Such legal relations, according to the author, include: payment legal relations; credit relations (including financial leasing relations); insurance legal relations; relations with the state and local budgets (regarding the payment of taxes and other obligatory payments and fees; receipt of state financial support); investment relations. Abstract:
The article examines the place of Natural Resource Law and post-resource branches of law in the legal system, proposes a hierarchy of these branches and outlines the relationship between the subjects of natural resource and post-resource relations. The subject of legal regulation of Natural Resource Law is defined as qualitatively homogeneous natural resource relations, consisting of the use and reproduction of natural resources – a legally defined part of the environment that have signs of natural origin and are in ecological relationship with the environment and with each other, can be used as a source of meeting human needs. All natural resources, as well as the relationship to their use and reproduction, are closely linked. This connection will always be inseparable and reciprocal. It is established that in the system of Natural Resource Law public relations regarding the use and reproduction of certain natural resources are in fact its subsectors and provide a differentiated approach to the environmentally sound use of each of the relevant natural resources. Natural Resource Law is not a conglomeration of land, water, forest and subsoil law, but their qualitative unity based on a single nature, factors of development and the internal structure of social relations. It is concluded that neither the long history of legislation, nor a significant amount of regulations that are sources of post-resource industries, are grounds for denying the inseparable and mutual connection of post-resource branches of law with each other and with Natural Resource Law and the objective need for separation independent branch of Natural Resource Law. Abstract:
The article provides a scientific and theoretical analysis of the legislation of the USSR, Ukrainian legislation. Particular attention is paid to establishing features in the legal regulation of seizure, utilization, destruction and disposal of unusable or prohibited pesticides and agrochemicals and containers from them. The authors conclude that today, given the need to improve the environment, more efforts are needed at the state level to utilize pesticides accumulated during the Soviet era, primarily to approve the state program with clear measures for its implementation and sources of funding. Today, regional state administrations have the opportunity without the intervention of the Ministry of Environmental Protection and Natural Resources of Ukraine to solve problems with obsolete pesticides and agrochemicals, as well as to determine where it is most profitable to dispose of these substances. Thus, to date, the process of reducing unusable pesticides has been launched. It aims to improve the ecological situation in the country, help reduce the negative impact on people's lives and health, and allow agriculture to develop. Abstract:
The article presents a scientific and theoretical analysis of the legislation that introduces green bonds as a tool for financing organic production, as well as identifies ways for its improvement. It is determined that a new type of securities – green bonds, can become one of the tools to support the development of organic agricultural production. It is proved that the allocation of environmental projects as a direction, which involve the use of funds raised from the issuance of green bonds, organic farming, is debatable, given the lack of normative definition of this concept, which may complicate the implementation of legislation and compliance with green bond issuance standards (Green Bond Principles). Based on the analysis of legal doctrine in terms of defining the concepts of «organic farming», «organic crop», «organic production», as well as features of organic production, it is concluded that organic crop, livestock, aquaculture fully meet the categories of environmental projects GBR principles (such as: ecologically sustainable agriculture, animal husbandry and aquaculture; agricultural technologies that do not harm the climate, etc.) It is proposed to set out the first paragraph of Part 2 of Art. 18 of the Law of Ukraine «On Capital Markets and Organized Commodity Markets» as follows: «environmental project is a project in the field of alternative energy, energy efficiency, minimization of waste generation, utilization and processing, introduction of environmentally friendly transport, organic production, conservation of flora and fauna, water and land resources, adaptation to climate change, and another project, aimed at protecting the environment, implementing environmental standards, reducing emissions into the environment». Abstract:
The article analyzes the legal support for combating and preventing domestic violence against women. The statistics show that in 2020 the bodies and institutions entrusted with the functions of implementing measures to prevent and combat domestic violence received 211,362 complaints about domestic violence, of which – 2,756 from children, 180,921 – from women , 27 676 – from men. It is concluded that the ratification of the Istanbul Convention is still open, which currently helps all signatory states to effectively combat a wide range of phenomena, including psychological violence, physical violence, sexual violence, especially rape, forced marriage, forced abortion, forced abortion, forced abortion. genitals, crimes in the name of so-called «honor», harassment, sexual harassment, etc. In addition, the need to ratify the Istanbul Convention has been and continues to be insisted on by the world community, as by signing this Convention, Ukraine has committed itself to ratifying it in the future. It is determined that the normative-legal provision of prevention and counteraction to domestic violence against women consists of a set of international covenants, declarations and conventions, normative-legal and by-laws normative-legal acts. It has been found that the number of reports of violence against women is increasing every year, so the legislator should work to prevent any forms of domestic violence by amending the legislation governing preventive measures. Abstract:
The article is devoted to the analysis of the institute of criminal liability and punishment for minors under the Ukrainian legislation. Theoretical and practical features of sentencing for criminal offenses are examined and the main tendencies of sentencing at the present stage are determined. It is stated, that certain provisions of the Criminal Code of Ukraine on the sentencing of minors do not correspond to the worldwide practice of humanizing the punishment for juveniles. It is determined that the purpose of criminal punishment for minors is the process of education. Also, it is proved, that this goal should be confirmed in the current Penal Code. Attention is focused on the fact that the backbone of the state strategy on criminal law counteraction to juvenile delinquency should be a child-friendly system of juvenile justice. The necessity of adding new types of punishment into Penal Code of Ukraine which would be applied only for young offenders is defined. Moreover, the expediency of forming a new system of punishment for juveniles, which would take into account more sophisticated and new educational measures is proved. The peculiarities of imposing criminal punishment on minors according to the legislation of other foreign countries are clarified. It is shown that special penalties for minors, which are not connected with isolation, are provided by the criminal legislation of most European countries. Abstract:
This article is devoted to the insufficiently studied in the theory of land law the concept of «subcategory of lands». The author established the fact that despite the widespread use of the phrase «subcategory of lands» by domestic and foreign scientists, there are no studies aimed at revealing this concept and outlining the same subcategories of lands. In the course of the research it was established that the current land legislation has about 119 subcategories of land, which are within different categories of land. Using the methods of theoretical and legal science, an attempt was made to reveal the concept of «subcategory of lands» and give it an appropriate definition. It is stated that subcategories of land play an important role in the proper functioning of current land legislation of our state, the lack of allocation and proper legal regulation of subcategories of land can lead to mass violations (intentional or negligent) in the use of land for its intended purpose. To effectively address the issue of proper legal regulation of land subcategories, the author analyzed the successful experience of the United States on this issue and proposed the development of a legal act that could perfectly regulate the relevant land categories, establish a full classification of major categories and subcategories. Lands, as well as provide them with a detailed description. In the final stage of the study, the author emphasizes that there is an urgent need to pay due attention to this issue by lawmakers, scholars and practitioners. Abstract:
The article is devoted to the analysis of the current state of legal protection of labor protection when performing work with pesticides, as well as the formulation on its basis of conclusions and proposals aimed at improving the current legislation in this area. It is established that the process of updating labor legislation is currently underway in Ukraine. In particular, through the adoption of regulations governing the rules of labor protection when working with certain types of chemicals (for example, ammonium nitrate). As a result of the study of current legislation in the field of labor protection when working with pesticides, it was concluded that the basic documents (State Sanitary Rules 8.8.1.2.001-98 «Transportation, storage and use of pesticides in the national economy» and State Sanitary Rules and Norms 8.8.1.2.3.4-000-2001 «Permissible doses, concentrations, quantities and levels of pesticides in agricultural raw materials, foodstuffs, air of the working area, atmospheric air, water of reservoirs, soil») are not able to regulate properly appropriate relations due to the obsolescence of their provisions. The main shortcomings of State Sanitary Rules 8.8.1.2.001-98 are determined: references in its content to already invalid regulations on labor protection, inconsistency with modern developments in the field of hygiene and toxicology of pesticides; unreasonably detailed regulation, which results in an excessive burden on business entities and leads to formalism in the implementation of the provisions of this document by employers; incorrect «rigid» regulation of the choice of personal protective equipment for work with pesticides. The directions of improvement of the legislation in the field of labor protection at performance of works with pesticides are defined. Among them: introduction of a risk-oriented approach to the organization of labor protection, including in the field of agriculture; borrowing positive international experience in the field of awareness of stakeholders on the hygienic regulation of pesticide use, the necessary safety measures for work with the use of such substances. Abstract:
The article is devoted to the analysis of the current state of the legislation of Ukraine in the field of hydraulic reclamation of lands, as well as to highlight the prospects for the development of legal support of the outlined sphere of public relations. It is established that hydraulic reclamation of lands contributes to increasing soil fertility, increasing productivity and sustainability of agriculture, creating a guaranteed food fund of the state. However, in recent years, the effectiveness of hydraulic land reclamation is declining, due to a number of reasons of objective and subjective nature: insufficient logistics and shortcomings in the operation of hydraulic structures, deterioration of ecological and reclamation of agricultural land, lack of interest and responsibility land users. These factors include incomplete use of scientific developments, insufficient information support, imperfect and outdated legal framework. Given the great importance of hydraulic land reclamation for the development of agriculture in the country, these relations require proper legal regulation. It is concluded that the problems of combating desertification, resource and food security of the state in years with adverse weather conditions, water supply of agriculture cannot be solved only by organizing land reclamation, because this problem is complex. In order to achieve the goals of the Irrigation and Drainage Strategy in Ukraine for the period up to 2030, it is necessary to ensure effective interaction of legal, organizational, economic and financial mechanisms of irrigation and drainage restoration in Ukraine within the framework of the identified priority areas. Abstract:
The importance of greening of modern agricultural production in terms of increasing the use of toxic substances of chemical or biological origin, which requires the direction of modern agricultural production in the direction of greening of artificial and natural factors of production, giving these issues extreme relevance. The conceptual and categorical transformation of ecological aspects of agriculture is given, which alternately took the form of the principle of agrarian law first as the principle of greening of labor in agriculture, then – the principle of greening of agriculture, ecological orientation of entrepreneurship in agriculture, and later – greening of agriculture and finally, acquired the formulation of the principle of greening of agricultural legislation. Other variants of the author's positions are also presented, among which the greening of agrarian law or directly the principles of agrarian law, as well as the state agrarian policy are considered. Based on the general nature of the principles, the implementation of which requires implementation in the regulations of the legislation, the priority of formulating the principle of greening of agricultural legislation is substantiated. At the same time, there are examples of greening the content of status agrarian laws, as well as non-«greening» status laws, which indicates the incomplete implementation of this principle in agricultural legislation. An array of functional agrarian laws is analyzed for certain areas of activity, which in quantitative terms and in terms of coverage outweigh the greening of status laws. Abstract:
The article analyzes the current approach to the identification of new branches in the legal system of Ukraine.The modern world does not stand still and is constantly evolving and gives impetus to the development of all spheres of human life, respectively, there are relationships that require legal regulation.Some scholars believe that in the presence of an independent subject of legal regulation, its ownmethodology of legal regulation and a set of specialized legislation, it is possible todistinguish an autonomousbranch of law. It is determined that the emergence of new branches of law is hindered by the dominant concept of the existence of only the main ones. Proponents of this concept categorically reject the possibility of the existence of relevant secondary, complex branches of law. This scientific approach inhibits the study of modern social relations. Negative attitudes towards the separation of new branches of law inevitably lead to gaps in the field of special legal research and, as a consequence, to a lack of qualified personnel with specialized knowledge. It is suggested to take into account the positive experience of foreign colleagues of lawyers who boldly present the achievements of current practices and are not afraid to consider them branches of law, we mean educational, sports, military, gender, «cryptocurrency», admiralty law and others. It is concluded that the division of law into new branches allows more effective regulation of legal relations in relevant areas, given that global trends are increasingly in demand for universal lawyers, but with specialization, with in-depth knowledge in one or more areas of law. Abstract:
The article examines the grounds and conditions of securing a claim in administrative proceedings. By analyzing the legal provisions, law enforcement (judicial) practice in connection with the acquisitions of legal science, the grounds and conditions of securing a claim in administrative proceedings are highlighted. Attention is focused on problematic issues that arise when courts check the grounds for securing a claim and compliance with the terms of securing a claim. In particular, attention is drawn to the fact that securing an administrative claim on the grounds of obvious signs of illegality of the decision, action or inaction of the subject of power is virtually inapplicable due to reservations about the inadmissibility of resolving the dispute on the merits. It is concluded that an administrative lawsuit can be secured if there is at least one of the grounds specified in part one of Article 150 of the Code of Administrative Procedure of Ukraine and compliance with the conditions of proportionality, adequacy of measures to ensure administrative lawsuit, direct connection with the subject matter and legal the defendant's conduct in the dispute. Emphasis is placed on the fact that the freedom of discretion (discretion) of the court in the application of measures to ensure an administrative claim is unconditional, but not unlimited and controlled by the requirement to properly justify the relevant procedural action. Abstract:
The World Health Organization notes the main issue that needs to be addressed - patient safety as prevention, avoidance, minimization of adverse effects of treatment. Normatively established obligation of the provider of the medical service (i.e. on its own initiative, which does not require prior consent or coordination with the patient) to provide information to the consumer. In the article, on the basis of an analysis of existing national legislation, judicial cases and theoretical, legal sources, explores issues relating to the realization and safeguarding of personal non-property rights that ensure the natural existence of an individual (art. 282-286 of the Civil Code of Ukraine) and legal mechanisms for protecting consumers' rights to information in the field of health care. The case law and the practice of the Constitutional Court of Ukraine in resolving cases on recognition and protection of the right to information about the state of health of a person are studied. Reasoned the proposals to address the shortcomings of legal regulation in the study area. The purpose of the article is an analysis of legislation and case law on the exercise of personal non-property rights in the field of health care. The issues of compliance with the regulatory requirements for the confidentiality of medical information in sick leaves, which still remain unresolved, are considered, especially considering the formation of a web-based service to ensure information interaction of the electronic health care system with the Electronic Register of sick leaves. Medical information, that is, a certificate of the state of health of a person, his or her medical history, the purpose of the proposed research and treatment, the prognosis of the possible development of the disease, including the existence of a risk to life and health, According to its legal regime refers to confidential, that is, information with restricted access. he introduction of effective legal mechanisms should help to improve the level of protection of rights, freedoms and interests of citizens. The issue of obtaining information on the state of health of a person by its heirs is a promising one and one that requires amendments to the legislation. Abstract:
The scientific and theoretical analysis of the legal basis of rural hospitality in Ukraine in terms of inclusive rural development is provided in this article. Particular attention is paid to justifying the necessity of developing and adopting a special law that would define the general legal, organizational and socio-economic principles of regulating the activities of citizens in this sphere. It is noted that the draft of Law of Ukraine «On Stimulating the Development of Rural Hospitality in Ukraine» is characterized by a number of positive features. There are: rural hospitality is defined as a diversified activity that can be carried out by each house hold located in the rural areas; the provision of rural hospitality services is not a business activity (Article 3 of theDraft). Thus, today a process of formation of the legislation in the sphere of rural hospitality takes place. Such legislation is aimed at creating the foundations for the broad involvement of the rural population in the provision of tourist services, improving its economic situation. This contributes to improving the level and quality of life in the rural areas, and ensuring inclusive rural development. Abstract:
The article examines the features of the legal regulation of the circulation of agricultural land between agricultural producers in the EU and identifies areas for improvement of domestic legislation in this area. The study shows that world experience indicates the existence of various models of legal regulation of land turnover among agricultural enterprises, which can be effective if you take into account the specific features of a country and national interests. Virtually every country in the world in one way or another regulates such circulation. There are countries with «hard» and «soft» regulation of land transactions between agricultural producers. But almost every developed EU country gives priority to farmers living in the area and running the farm, in contrast to large agricultural holdings. Despite the fact that in the EU countries the legislation on the circulation of agricultural land between agricultural producers is based on different models of legal regulation, the positive experience of these countries should be used to improve domestic legislation in this area. In the field of legal support for the use of land by agricultural producers, it is necessary in domestic land legislation to pay special attention to the granting of preferential rights to acquire agricultural land to farms, local communities, tenants, etc.; provide for the establishment of a preferential procedure for the acquisition of such land and the provision of tax benefits; and to determine the limits of land concentration at the level of oblasts and united territorial communities or to establish a permitting procedure for the acquisition of land plots with an area larger than that established in the territory of a certain oblast or united territorial community. Abstract:
The article examines the formation of communal land ownership law, formation of legal regulation in the field of consolidating the status of territorial communities as subjects of communal property, the impact of decentralization of powers processes on resolving the issue of the legal regime of territorial communities’ lands and united territorial communities’ lands, determination of scientific approaches to the formation of the model of communal land ownership law in Ukraine. It is updated the legislator’s inconsistency in determining the principles of building the institution of communal land ownership law, lack of a well-founded concept of communal property law, legislative contradictions of approaches to the creation of sustainable local self-government in Ukraine, based on the priority of land interests of territorial communities. Scientific attention is paid to preconditions for determining the constitutional status of territorial communities, legislative consolidation of the grounds for the formation of communal land ownership in the state, solving the problem of the definition of «communal land ownership law» absence in current legislation. Focused attention on legitimization of the powers to exercise the communal property law through the solution of the issue of land and legal competence of territorial communities, improvement of their status as subjects, who exercise the right of communal ownership of land directly or through local governments, the exercise of the right of communal ownership of land in the ways specified in the land law. According to the study it is established that the Constitution of Ukraine has provided the necessary prerequisites for the formation of a fundamentally new land system in the field of communal property on the land of communities. An important scientific task in modern conditions is improving the legal regulation of land and legal competence of territorial communities as subjects of communal land ownership for the sustainable development of territories. It is determined that the acceleration of administrative and land reforms will contribute to the full legitimization of the united territorial communities and the formation of territorial communities as equal subjects of land ownership. Abstract:
The article is provided a scientific and theoretical analysis of trends in Ukrainian legislation in the field of agricultural cooperation. The author notes that in the Law of Ukraine of July 21, 2020 «On Agricultural Cooperation» (new Law) on the one hand, describes in detail the basics of functioning of these entities, but, on the other – its content almost completely eliminates the basic principles of agricultural cooperation established by domestic law and also contradicts the principles of the cooperative movement. There is a general negative trend in the development of legislation on agricultural cooperation. It is already traced in the Law of Ukraine of November 20, 2012 «On Amendments to the Law of Ukraine «On Agricultural Cooperation», that is characterized by «truncated form» (out of 38 articles, only 16 remained), significant number of reference provisions, establishing advantages for the development of agricultural service cooperation. With the adoption of the new Law, this negative trend has deepened and is in the artificial separation of agricultural cooperation from the cooperative system and the gradual loss of its social orientation. This approach is unacceptable and will negatively affect the further development not only of agricultural cooperation as a socio-legal phenomenon, but also of agricultural production and the social sphere of the countryside. Abstract:
The article analyzes the scientific approaches to the content of the concept of «public administration», «public administration in the activities of the court staff». It is noted that the establishment of the essence of public administration, its features and the actual formulation of the definition of public administration in the court staff, which would fully reflect its legal nature, is the most pressing issue in the light of judicial reform. It is argued that a separate component of building the organizational structure of the court staff is the established practice of organizing activities in each court, taking into account which, the court administration develops and approves standard staffing schedules for each group of courts; on the basis of the maximum number of civil servants and technical staff, the staffing schedules of courts are approved by the heads of their staff and chairmen of courts. It is proved that public administration in the activity of the court staff has not been studied in detail. Doctrinal teachings on the understanding of administration in the judiciary are in many cases opposite and ambiguous. When characterizing public administration in the judicial system, the semantic load is focused on the characteristics of: «organizational support of the courts», «judicial management», «organizational management of courts», administrative relations that exist in the judicial system. Also, the scientific article analyzes the content of the concept of «public administration in the court staff», where we argue that public administration in the court staff is designed primarily for quality organizational support for timely, complete, public and independent work of the court. Therefore, ensuring the functioning of the courts is not only the procedure of justice itself, but first of all organizational support. Efficiency, efficiency, accessibility are a direct impact on the performance of judges directly, and this, accordingly, a positive reputation of the judiciary among the population. Creating the right regulator of the administration in the courts is the key to meeting the requirements of society and ensuring the smooth operation of the judicial system as a whole. Abstract:
The article is devoted to the definition of the concept and types of subjects of legal relations in the field of organic agricultural production based on the analysis of doctrinal approaches and provisions of domestic and international law. Applying the approach «from general to specific» the concepts of «subjects of legal relations», «subjects of agrarian legal relations», «subjects of legal relations in the field of organic agricultural production» are investigated. It is concluded that the concept of «agricultural producer» is generalized and covers all producers of such products, regard less of the object of production and other characteristics of this entity and the production process. Formulated is the concept of «producer of organic products (raw materials)» – a subject of agrarian legal relations, which independently owns and disposes of separate property, in the property complex of which the main means of production is a natural object – agricultural land used by it for organic production, as well as processing of raw materials of plant and animal origin, or a fishery facility for the production and processing of aquaculture facilities in order to ensure food security, subject to compliance with environmental safety requirements. The basic constitutive features of producers of organic products (raw materials) are determined: the presence of a certificate of conformity and inclusion in the registers according to the legislation. It is substantiated that the main subjects of legal relations in the field of organic agricultural production are individuals and legal entities engaged in the production and/or circulation of products in accordance with the requirements of legislation in the field of organic production, circulation and labeling of organic products. Auxiliary subjects of legal relations in the research area are certification bodies, public authorities with powers in the field of regulation and control over such activities, as well as processing, procurement, marketing, supply, service and other agricultural entities, the public. Abstract:
The article draws attention to the specifics of protection of intellectual property rights in Ukraine by civil and special legislation, the rules of which are designed to protect the subjective rights of right holders and other participants in legal relations in the field of intellectual property. Some aspects of the legal nature of jurisdictional remedies are studied. Attention is paid to the specifics of protection of intellectual property rights by civil law, which consists primarily in the methods of protection provided by procedural law. The legislation, the norms of which guarantee the protection of intellectual property and the ways of protection of civil rights are outlined. The existing in the legal literature different views on the classification of methods of protection of property rights are analyzed. The legal analysis of the application of the vindication claim as a means of protection of intellectual property rights is carried out and the author's proposals are formulated. Abstract:
The article considers the concept of «information», its interpretation and definition by both scientists and the Law of Ukraine «On Information». The main principles of information relations are presented. The main directions of the state information policy are noted. The key types of information are covered. Definition and legal regime of scientific and technical information are presented. It is indicated that scientific and technical information covers the results obtained in the process of scientific and research, research and development, design and technological, production and public activities, recorded in a form that ensures their reproduction, use and dissemination. It is stressed the need to expand the direction of information development, not limiting this area only by technical component of scientific activity and ignoring the humanitarian direction, because the information concerning scientific activity in general, including in the humanities, in the sphere of social sciences and in other scientific spheres is left out of consideration. It is noted that the main base of the scientific and technical information is formed with information resources, which are a systematic collection of scientific and technical literature and documents (books, brochures, periodicals, patent and design documentation, industrial catalogs, deposited manuscripts, scientific and research reports) fixed on papers or other storages. The main types of information activities and areas of information are given. The importance of information support in conducting scientific research is indicated and the search for the necessary information is of great significance for the effective conduct of scientific research, as the researcher spends about 50 % of his time on the process of finding information. Abstract:
This article is devoted to the analysis of domestic and international legal bases of use of antibiotics in organic animal husbandry, and also formulation on its basis of the conclusions and offers directed on improvement of the current agrarian legislation in the specified sphere. It is determined that the reform of Ukrainian legislation on veterinary medicine and feed takes in to account the main international requirements for regulating the use of antibiotics in animal husbandry, in particular Regulation (EU) 2019/6 of the European Parliament and Council of 11.12.2018 «On veterinary medicinal products and repealing of the Directive 2001/82/EU». For the effective implementation of legislative requirements in practice, the need to continue working in the following areas is justified: development of by laws in the field of antimicrobial drugs in animal husbandry; collection, accumulation and analysis of information on the amounts and types of antibiotics used by agricultural producers; development of advanced livestock technologies without the use of antimicrobials, taking in to account the positive experience of other countries; dissemination of knowledge about such technologies among agricultural entities. As a result of the study of the current legislation in the field of organic agricultural production, it was concluded that the legal regulation of the use of antibiotics in organic animal husbandry meets international requirements, namely such basic documents as Commission Regulation (EU) of 05.09.2008 № 889/2008 «Detailed rules on organic production, labeling and control for the implementation of Council Regulation (EU) № 834/2007 on organic production and labeling of organic products» and Council Regulation (EU) № 834/2007 «On organic production and labeling of organic products, and repealing the Regulation (EEC) № 2092/91». To improve the mechanism of control and trace ability of antibiotics in the treatment of farm animals in organic animal husbandry, it is proposed: to accelerate the work on the adoption of the Procedure for the use of antimicrobial drugs in veterinary medicine; to supplement the Procedure (detailed rules) of organic production and circulation of organic products with provisions on the requirements for documentary confirmation of the use of antimicrobial drugs by operators, storage periods of relevant documents. Abstract:
Effective legal regulation of environmental protection and protection of environmental relations in modern conditions is a necessary condition for the successful development of human society. The scientific opinions on the organization of activity of ecological courts are covered, the normative-legal acts regulating ecological legal relations are analyzed. The conclusion on prospects of introduction of ecological court in Ukraine is made. To this end, it is necessary to reform the legislation on the judiciary, update procedural legislation to ensure a harmonious combination of private and public interests in the field of environmental relations. Abstract:
The article analyzes the contracts and licensing regulations in the field of amber mining. It is noted that Ukraine from the first years of independence began to develop local amber deposits and immediately encountered problems similar to those of amber plants in Russia and Poland: lack of protection of natural resources from looting and destruction, theft at all stages of exploration. exploration work, illegal amber mining and trafficking, illegal fishing by miners (diggers), etc. Ukraine ranks second in the world in terms of amber deposits, which also has the world's highest percentage of amber jewelry quality. It is determined that the problem of illegal amber mining has become especially relevant, as cases and volumes of such amber production have grown significantly. The issue of illegal amber mining and smuggling is also widely discussed in the media, as journalistic investigations often show that officials and high-ranking officials play a significant role in sustaining and benefiting from this shadow business, although these rumors are not officially confirmed. It is concluded that in modern conditions the issue of permitting regulation of legal amber mining and punishment of subjects of its illegal mining is on the agenda. Significant progress in permitting regulation was the adoption by the Verkhovna Rada of Ukraine in December 2019 of the Law of Ukraine «On Amendments to Certain Legislative Acts of Ukraine on Settlement of Amber Mining» № 2240, which amended the Subsoil Code of Ukraine, which introduced a new species subsoil use «geological study of amber subsoil, including experimental and industrial development of deposits with subsequent extraction of amber (industrial development of deposits»), as well as the presence of a mandatory permit for special subsoil use for subjects of amber subsoil use.
