RESUMO: As rearticulações contemporâneas do neoliberalismo têm promovido o aprofundamento das transformações na instituição central da modernidade. O Estado e todas suas instituições, e aqui se destaca o Poder Judiciário, tem passado por importantes redimensionamentos. Neste contexto, o presente artigo, construído por meio de uma revisão bibliográfica interdisciplinar, enfrenta o conjunto de câmbios que passa a jurisdição, dentro do cenário multifacetado de crises estatais. Partindo do reconhecimento de que na globalização tem-se a instauração de uma nova racionalidade que “orienta o mundo”, traz a reflexão sobre a forma como o espaço judicial tem tido redefinidas as funções e a operacionalidade, em face das demandas por uma gestão eficiente. A hipótese de trabalho envolveu a compreensão de que as mudanças pelas quais passa o sistema de justiça estão orientadas por discurso que sacrifica a justiça sob o primado do aumento da produtividade e diminuição das despesas. Assim, a racionalidade econômica-concorrencial passa a impor diretrizes gerencias ao sistema de justiça, o que se repercute no sacrífico da base de legitimidade material de atuação. PALAVRAS-CHAVE: Neoliberalismo, Crises do Estado, Jurisdição. ABSTRACT: The contemporary neoliberalism rearticulations has further the deepening of the central institution of modernity. The State and all its institutions, and here the Judiciary Power enhance, has been through important resizes. In this context, this paper, built by an interdisciplinary literature review, faces the exchange set that jurisdiction passes, inside a multifaceted scenario of State Crisis. Starting from the recognition that in the globalization there are the establishment of a new rationality that “guides the world”, brings the reflection about how the shape of the judicial space has been redefined it functions and the operability, in view of demands for an efficient management. The working hypothesis has involved the understanding that the changes that the justice system has been through are guided by a speech that sacrifices the justice beneath increase of the productivity and the reducing expenditure. So, the economic-competitive rationality starts to impose management guidelines to justice system, which impact on the sacrifice of the basic legitimacy of acting material.
