A importância da autocomposição a partir das teorias de Jürgen Habermas e Axel Honneth

Abstract

Resumo: O presente artigo objetiva analisar a importância da autocomposição dos conflitos a partir das teorizações de Jürgen Habermas e Axel Honneth. Investiga, inicialmente, como a teoria habermasiana do agir comunicativo permite compreender o funcionamento dos mecanismos autocompositivos, bem como a forma como eles se apropriam da dinâmica dos conflitos para restaurar o canal de diálogo entre partes e favorecer o surgimento de soluções mutuamente satisfatórias. Em seguida, avalia como a reformulação da teoria da justiça de Honneth afeta a compreensão do sentido ético da liberdade jurídica das sociedades contemporâneas, e, ainda, como a democratização dos espaços de interação poderia contribuir para reforçar a liberdade e a autonomia dos cidadãos. Os referenciais filosóficos analisados denotam que a autocomposição constitui-se em legítimo instrumental de emancipação social. Palavras-chave: Autocomposição; Jürgen Habermas; Axel Honneth. Abstract: This article aims to analyze the importance of consensus building in the works of Jürgen Habermas and Axel Honneth. It initially investigates how the habermasian theory of communicative action allows us to understand the functioning of the alternative dispute resolution mechanisms and the way they make use of the dynamics of conflict to re-establish the channel of dialogue between parties, as well as encourage the emergence of mutually satisfactory solutions. It also highlights how Axel Honneth´s theory of justice affects the understanding of the ethical sense of the legal freedom in contemporary societies, and also how the democratization of spaces of interaction would help citizens to strengthen their freedom and autonomy. The philosophical reference analyzed denotes that consensus building constitutes a legitimate instrument of social emancipation. Keywords: Consensus building; Jürgen Habermas; Axel Honneth.
