Abstract:
Reasoning various negative perceptions towards the direction of national education that has been considered not to characterize the national personality, especially about the output of education that tends not to reflect the values and principles of anti-corruption in work and daily, so that through formal education there should be an increase in terms of intensity. Simplistically, the formal education sector in Indonesia can play a role in meeting the need for corruption prevention. Preventive measures can indirectly pass through two approaches, first: targeting learners, and second: using the empowerment of learners to reduce the environment from permissive to corruption.As for the problems in this paper is how the anti-corruption education policy in Higher Education and the extent of anti-corruption education policies in the prevention of corruption. With the aim to understand and analyze the role of anti-corruption education in growing the values and principles of anti-corruption from an early age.Through this anti-corruption education will be a provision for students to act honestly in the work. Of course, in order not to commit acts of corruption when later occupied a strategic position in an institution or served an important position in this bureaucracy. The facts show that highly educated people are vulnerable to the temptations of corruption because they usually occupy strategic positions in an institution or hold important positions in the bureaucracy.

Abstract:
Perempuan adalah salah satu subyek hukum yang turut mempengaruhi keberlakuan hukum dimasyarakat. Korupsi adalah suatu kejahatan yang sistemik dan endemik . korupsi memiliki dimensi gender. Jika tidak ada penanganan dan upaya pencegahan yang menyeluruh maka dapat dipastikan negara akan hancur. Perempuan dengan segala sumber daya yang ada pada dirinya memegang peranan penting dalam kelanjutan hidup generasi, perempuan adalah sosok terdekat yang membentuk karakter anak dan memberi warna pada kehidupan rumah tangganya. Saat ini, fakta menunjukkan perempuan berada dilingkaran tindak pidana korupsi. Ketidakberdayaan perempuan pada ruang publik dengan sistem korup atau tudingan perempuan menjadi salah satu penyebab korupsi pada ranah domestik semakin membuat kedudukan perempuan terpojok. Namun, masih ada harapan untuk perempuan bangkit memperbaiki keadaan. Ekspektasi perempuan dalam memberantas korupsi di pengaruhi oleh dukungan sosial yang baik, kepercayaan religius, dan kontrol sosial.

Abstract:
Generally, the GDPR applies to data processing activities conducted by organisations established in the European Union (EU). But in certain activities, GDPR may also apply outside EU according to extra-teritorial principle. This principle has correlation to concept of sovereignty in international law. This article aims to examine whether a state must abide to GDPR when the requirement fulfiled or should the states use their sovereignty as a basis to deny it. This article is normative legal research. It focus on case-law, statutes and other legal source as primary and subsidiary source. The analysis is deductive by reasoning from more general to more specific. The result show that extra-teritorial principle under GDPR is in accordance to international law. The practice is common in the world in order to protect the citizen and national interest from any threat from abroad. The chance of overlapping between this principles with state’s sovereignty is hardly to occur as the principle only works when the interest of European citizen violated.

Abstract:
Pada saat ini banyak lembaga pembiayaan dan bank menyelenggarakan pembiayaan bagi konsumen (consumer finance), sewa guna usaha (leasing), anjak piutang (factoring). Mereka umumnya menggunakan tata cara perjanjian yang mengikutkan adanya jaminan fidusia bagi objek benda jaminan fidusia. Pada pelaksanaannya seringkali terjadi kelalaian debitur dalam melaksanakan kewajibannya. Mengatasi masalah tersebut, cara yang paling sering digunakan oleh kreditur adalah memakai jasa debt collector. Keberadaan debt collector untuk melakukan penagihan kredit sering membuat resah debitur. Keberadaan debt collector yang telah lama sangat meresahkan masyarakat direspon oleh Mahkamah Konstitusi dengan mengeluarkan Putusan Nomor 18/PUU-XVII/2019 tanggal 6 Januari 2020. Dalam putusan tersebut mekanisme eksekusi obyek jaminan fidusia diubah oleh Mahkamah Konstitusi sepanjang tidak diberikan secara sukarela oleh debitur. Sebelumnya, UU Fidusia membolehkan kreditur mengeksekusi sendiri objek jaminan fidusia, namun sekarang untuk melaksanakan eksekusi, kreditur harus mengajukan permohonan kepada Pengadilan Negeri. Namun pelaksanaan eksekusi langsung oleh kreditur tanpa melalui PN bisa dilakukan jika debitur mengakui adanya wanprestasi atau cedera janji dalam perjanjiannya dengan kreditur.

Abstract:
Hukum merupakan suatu hal yang melindungi hak seseorang dan suatu hal yang digunakan untuk membuat ketertiban di masyarakat, hukum di Indonesia adalah hukum peninggalan dari Belanda, Indonesia belum mampu membuat hukum sendiri. Meskipun hukum itu memiliki sifat yang memaksa dan memiliki sanksi yang tegas tetapi masih ada saja masyarakat yang tidak mau mematuhi hukum dan melanggarnya negara pun juga merasa kesusahan karena Indonesia adalah negara yang terdiri dari pulau-pulau yang dipisahkan oleh lautan yang luas, oleh karena itu Indonesia memiliki keanekaragaman budaya, bangsa, agama, ras, suku. Indonesia adalah negara yang berprinsip sesuai dengan sila pertama yaitu Ketuhanan Yang Maha Esa dengan sila pertama tersebut Indonesia merupakan negara yang beragama meskipun bukan negara yang hanya menganut satu agama. Agama dapat hidup dan berkembang di Indonesia karena ada perlindungan hukumnya dan para pemeluk agama berhak melaksanakan dan mengembangkan agamanya berdasarkan kepercayaanya, dan karena keanekaragaman inilah yang menyebabkan berbagai permasalahan dapat terjadi di Indonesia salah satunya adalah penistaan agama, apabila menyinggung masalah agama masyarakat Indonesia sangat sensitif sekali mengenai hal tersebut. Kegiatan yang dilakukan oleh sekelompok ataupun individu yang didasarkan kepada pelecehan terhadap suatu keyakinan agama dan dilakukan dengan cara yang menyimpang dari ajaran agama yang bersangkutan sehingga menimbulkan keresahan terhadap kehidupan beragama menyebabkan timbulnya kerawanan dalam kehidupan masyarakat antar umat beragama. Di Indonesia telah ada Undang-undang dan pasal yang mengatur mengenai permasalahan penistaan agama yang terdapat dalam KUHP pasal 156, 156 a termasuk dalam tindak pidana pelecehan. Masyarakat di Indonesia harus memiliki atau menanamkan sifat toleransi dalam diri mereka agar terhindar dari segala macam permasalahan yang dapat memicu timbulnya konflik yang menyebabkan perpecahan ditengah-tengah masyarakat. Law is something that protects a person's rights and something that is used to make order in society, the law in Indonesia is a legacy from the Netherlands, Indonesia has not been able to make its own laws. Even though the law has a compelling nature and has strict sanctions but there are still people who do not want to obey the law and violate the state, they also feel troubles because Indonesia is a country consisting of islands separated by vast oceans, therefore Indonesia has a diversity of cultures, nations, religions, races, tribes. Abstract:
Eksistensi Pengadilan Hak Asasi Manusia Terhadap Penegakan Hak Asasi Manusia Dalam Sistem Peradilan. Penelitian ini dilakukan dengan bertujuan untuk: (1)Menganalisis dan Menjelaskan eksistensi pengadilan Hak Asasi Manusia terhadap suatu perkara; (2) Menganalisis dan Menjelaskan peran pengadilan Hak Asasi Manusia dalam mewujudkan kepastian hukum pada sistem peradilan pidana. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif atau doctrinal, yang melihat hukum sebagai sistim konseptual, sistim nilai dan sistim norma, sehingga bahan primer yang digunakan dalam penelitian ini adalah norma dasar yaitu Undang Undang Dasar Negara Republik Indonesia Tahun 1945, dan Peraturan perundang-undangan serta Putusan-putusan Mahkamah Konstitusi yang berkaitan dengan penelitian ini. Analisis terhadap bahan-bahan hukum tersebut, dilakukan dengan menggunakan analisis isi (content analisys). Hasil penelitian ini menunjukkan bahwa: (1) Eksistensi pengadilan Hak Asasi Manusia terhadap suatu perkara masih banyak mengandung kelemahan yang mengakibatkan hambatan yuridis dalam penerapan Undang-Undang No. 26 Tahun 2000; (2) Pengadilan Hak Asasi Manusia dalam sistem peradilan pidana dapat mewujudkan kepastian hukum bahwa hukum acara yang digunakan dalam pengadilan Hak Asasi Manusia Ad Hoc sama yang digunakan dalam hukum acara pengadilan Hak Asasi Manusia yaitu menggunakan ketentuan dalam Undang-Undang No. 26 Tahun 2000. Agar penerapan Undang-Undang No. 26 Tahun 2000 berjalan dengan baik pemerintah perlu mengamandemen Undang-Undang No. 26 Tahun 2000 agar secara lengkap menyesuaikan tindak pidana yang diatur yaitu kejahatan terhadap kemanusiaan dan kejahatan terhadap genosida yang seharusnya disertai dengan penjelasan mengenai unsur tindak pidananya.

Abstract:
The scope of land disputes that became the competence of the State Administrative Judicature according to the judicial principle adopted in Indonesia, the implementation of the Decision of the State Administrative Court in the settlement of land disputes.This research is conducted through normative legal approach (juridical normative), that is how law is utilized as an instrument to realize the application of land dispute resolution mechanism through authority to try State Administration Court. This research uses normative legal research type to identify and analyze legal factor which is an obstacle in the application of legislation, where this study refers to the laws and regulations on land and State Administration Judicature Law, court decisions and other legal materials.That the State Administration Dispute in the field of land arises because of a written stipulation issued by the State Administration or Administrative Officer containing State Administration law action which in accordance with the prevailing laws and regulations has been concrete, individual and final in the form of land certificate of ownership the right to land issued by the Government. Implementation of the Decision of State Administration which has been decided and has the force of law in practice raises a polemic in the community where the State Administration officials are not willing to carry out the decision of the Administrative Court of the State. This condition is caused because the State Administrative Court is not the executor (executor of the decision) but only as supervisor of the implementation of the decision, for all government actions in order not to violate the law and the role of legal protection for the community.

Abstract:
Implementation of disciplinary sanction regulation for state civil apparatus within the local government of regional civil service employee education and training in northern gorontalo and Constraints faced by the Regional Personnel Board of Education and Training Kabupaten Gorontalo Utara in increasing the application of disciplinary sanction regulation for the State Civil Apparatus. To know the implementation of disciplinary sanction regulation for civil state apparatus in the local government of civil service agency of education and training area of north gorontalo district and to know the obstacles faced in Regional Personnel Board of Education and Training of North Gorontalo Regency in increasing the application of disciplinary sanction regulation for State Civil Apparatus. This type of research is descriptive normative research that is a research that emphasizes on the real condition of the field which then synced on the rules - the rule of law, rule of law law, the opinions of scholars and regulations related to the research. This research was conducted to obtain information, explanation and data on the application of disciplinary sanction regulation for civil apparatus of state environment of local government of north gorontalo district. the application of disciplinary sanction regulation for state civil apparatus within the local government of the regional civil service agency of education and training of northern gorontalo district is in accordance with prevailing provisions, namely PP. 53 of 2010 on the discipline of civil servants and obstacles encountered in the Regional Personnel Board Education and Training District of North Gorontalo in increasing the application of disciplinary sanctions regulation for the State Civil Apparatus that is the length of the reporting process from the prosecutor to the Regional Personnel Board of Gorontalo Utara for specific disciplinary sanctions the case of a criminal offense. The mistake is due to the State's Civil Apparatus itself, which lacks the discipline of the civil state apparatus, the duration of the disciplinary sanction process itself due to the length of the process of applying disciplinary sanction regulation in accordance with pp 53 of 2010.

Economic neglect is one form of domestic violence that has occurred even in small intensities. Behavior or acts of violence in the household as a social fact is not a new case in Indonesian society. Domestic violence (KDRT) is a social fact that is universal because it can happen in a household. Abandonment of households is one of the prohibitions that includes the scope of domestic violence as contained in Article 5 of the Law on the Elimination of Domestic Violence (UUPKDRT).

Abstract:
Safety is a top priority in the world of aviation, the government is committed that "Safety Is Number One" is in accordance with Law Number 1 of 2009. Flight safety is a condition of fulfilling safety requirements in the use of airspace, aircraft, airports, air transport, flight navigation , as well as supporting facilities and other public facilities. This research was carried out at the Gorontalo District AIRNAV Indonesia Office, in Gorontalo Jalaludin Airport. Data collection methods using questionnaires and observations. The data of this study were analyzed using correlation tests derived from the SPSS Release 15.0 Program. The results of the analysis show that H0 is rejected and Ha is accepted, which is indicated by a significance value of 0.000
