Abstract:
This study aims to examine the implementation of legal protection for the fishermen community in Pabeanudik Village. This research combines normative juridical and empirical research methods. The primary data were collected using direct interviews, while the secondary data was collected using literature study techniques. The data obtained in this research were then analyzed qualitatively to describe the problem and answer study purposes. The results show that there are contradictory explanations from several laws and regulations regarding the status of fishermen as legal subjects. In addition, most Fishers do not receive guarantees of safety and security from Fishing Vessel Owner when going to sea on the high seas. In addition to weak legal protection, Fishers also received less guidance and guarantees for legal assistance from the Local Government. Therefore, it is recommended that the Government make amendments to several laws and regulations. In this case, to equalize the explanation of the status of fishermen as legal subjects. Furthermore, the Local Government must implement protection and empowerment policies regulated in laws and regulations. These include business certainty, elimination of high-cost economic practices, provision of production facilities and infrastructure, guarantees against risks in the fishing business, and assistance for fishermen who have difficulty catching fish. In addition, support in the form of protection and empowerment is given exclusively to small fishermen and fishers so that the series of problems described can be minimized in the future.

Abstract:
This study aims to examine and analyze the independence and accountability of the Constitutional Court in the constitutional system in Indonesia. This study uses a normative juridical method with a statute approach. The collection of primary, secondary, and tertiary legal materials is carried out using literature study techniques. The collected legal material is analyzed using qualitative data analysis methods to describe the problem and answer study purposes. The results show that the Constitutional Court acts as the interpreter and guardian of the constitution. In addition, the Constitutional Court also acts as a guardian of human rights, citizens’ constitutional rights, and democracy. Furthermore, independence and accountability in a judicial process are like two sides of a coin. These cannot be separated because the two principles complement each other. Although the Constitutional Court has implemented duties and functions based on the principle of accountability. However, the independence of the Constitutional Court as the executor of Judicial Power has finally been lost. The Constitutional Court is now a judicial institution whose position is limited to sub-ordination from the other spheres of State Power which proposes Judges to fill in the Constitutional Court. Therefore, it is recommended that Constitutional Judges maintain their independence even though their positions result from proposals by other spheres of State Power. It is also recommended that the President and the House of Representatives uphold the mechanism of checks and balances between spheres of state power based on democratic principles. In this case, to realize the ideals of a law-based and democratic-based state for the sake of a more recognized national and state life.

Abstract:
This research aims to examine and analyze the benefits obtained by MSME actors in Surakarta after registering their trademarks. This research uses the empirical research method. The primary data were collected using direct interviews. The data obtained in this research were then analyzed qualitatively to analyze problems and answer study purposes. The results show that the IPR has provided legal certainty and protection for the Owner. Apart from getting legal protection, the rights Owner of the trademark also gets material and immaterial benefits. In this case, the rights Owner of the Mal Mel trademark feels the immaterial benefits. Furthermore, the rights Owner of the Mal Mel trademark prefers to give a direct warning if she finds a social media account plagiarizing his trademark rather than through positive legal procedures. At the same time, the rights Owner of the Mal Mel trademark does not think of making a profit by earning and receiving compensation from plagiarists. Therefore, it is recommended for every business actor, especially those with large and developing scales, to register their trademarks. In addition, MSME actors can also register the trademark to DGIP using the collective system. On the other hand, it is also recommended for the Government increase public understanding and trust in solving problems through positive legal procedures, even though the crime of IPR plagiarism is included in the category of constituted complaint delict.

Abstract:
This study will examine and analyze the legal consequences for LDMO disclosing the personal data of transacting parties. In addition, this study also aims to determine the legal protection for parties who suffer losses due to violations committed by the LDMO. This study uses a normative juridical method. The collection of primary, secondary, and tertiary legal materials is carried out using literature study techniques. The collected legal material is then analyzed using qualitative data analysis methods with a statute approach. The results show that LDMO will get a sanction of dishonorable dismissal, payment of compensation, imprisonment for a maximum of four years, and or a fine for a maximum of four billion rupiahs. In this case, if the LDMO is legally and convincingly proven to have violated the oath of office and caused loss to several parties by disclosure of personal data. At the same time, forming the LDMO Guiders and Supervisors Council is a form of legal protection for all parties who commit legal acts before LDMO. In this case, any party that suffers a loss can complain about the alleged violation committed by LDMO to the Guiders and Supervisors Council. In addition, any party that suffers a loss also gets compensation from LDMO as regulated in laws and regulations. Therefore, it is recommended that LDMO uphold the oath of office as a moral code regulated in the Code of Ethics and Head of the NLA Regulation. In this case, to maintain their profession’s dignity and public trust in their noble role (officium nobile).

Abstract:
This study will examine and analyze the status and position of the SHM of Condominium Units in the building Blok-A of Makassar Mall after a fire. This research combines normative juridical and empirical research methods. The primary data were collected using direct interviews, while the secondary data was collected using literature study techniques. The data obtained in this research were then analyzed qualitatively. The results show that the SHM of Condominium Units in building Blok-A of Makassar Mall is still in the status quo. Meanwhile, the fire phenomenon and implementation of the construction of the new building Blok-A of Makassar Mall cannot be qualified as a requirement for the removal of the SHM of Condominium Units. In this case, implementing that construction is a form of PT. MTIR’s obligation to the Makassar Municipal Government based on the agreement held under the BOT system. In contrast, PT. MTIR made efforts to usurp the rights owned by traders as holders of SHM of Condominium Units in the building Blok-A of Makassar Mall. Therefore, it is recommended that the Makassar Municipal Government re-evaluate the involvement of PT. MTIR as the Holder of the Right to Build for Makassar Mall Shopping Center. In addition, it is recommended that PT MTIR register for the transfer of the right based on Government Regulation No. 24 of 1997 if they continue to impose their will to become the holder of the SHM of Condominium Units in building Blok-A of Makassar Mall. Furthermore, it is recommended that law enforcement agencies conduct investigations related to the Collaboration Agreement No. 44/511.2/SP/HK along with the accompanying addendums. In this case, traders must get legal certainty and protection as holders of SHM of Condominium Units in the building Blok-A of Makassar Mall.

Abstract:
This study aims to examine and analyze the dichotomy between doctrinal and non-doctrinal approaches in the study of legal science. This research uses normative research methods. The collection of legal materials is done by using literature study techniques. The legal material obtained in this study was then analyzed qualitatively with a comparative approach to present conclusions and answer the research objectives. The results show that the dichotomy of approach in the study of legal science is a scientific dynamic in line with social changes in the community. The doctrinal approach is a normative legal study that always focuses on norms that are none other than the character of legal science itself. In contrast, the non-doctrinal approach is an empirical legal study that crosses other scientific disciplines and does not ignore legal norms as the character of legal science. In addition, the doctrinal approach determines substantially what is allowed and what is not (das sollen). At the same time, the non-doctrinal approach corrects legal behavior as nothing but a judiciary that creates justice, certainty, and utility in the empirical realm (das sein). Therefore, it is recommended for legal academics to have progressive legal thought construction. In addition, the government must ensure every legal academic’s competence when making academic manuscripts of Laws and Regulations Draft. In this case, the rule of law must achieve social justice for Indonesia’s people.

Abstract:
This study examines and analyzes the effectiveness and efficiency of the convict self-development program in the penitentiary using legal and economic approaches. This study uses empirical legal research methods. The primary data were collected using direct interviews with four informants. While the secondary data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The data obtained in this research were then analyzed using qualitative data analysis methods with a legal and economic approach. The results show four concepts and five principles for conducting legal and economic analysis. Legal and economic analysis shows that the convict self-development program in Class 1 Penitentiary of Makassar is not running effectively and efficiently based on four factors: legal, law enforcement, facilities, and community. Therefore, it is recommended for MoLHR to make Regulations on observation, assessment, and reporting for implementing the convict development. Furthermore, it is recommended that the Director General of Correctional make Regulations on The guidance for implementing Correctional Guardian. In addition, there should be a restoration of regulations related to the role of correctional guardians as certain functional positions in the Penitentiary. In this case, the convict self-development program in the future can be carried out more focused, measurably, and systematically.

Abstract:
This study examines and analyzes the legal protection for Investors from the activities of uncertified crypto asset physical Traders. This study uses a normative juridical research method with a statute approach. The data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The collected legal material is then analyzed using qualitative data analysis methods. The results show that the Government has provided legal protection for investors from the activities of uncertified crypto asset physical traders based on Law No. 10 of 2011, CoFTRA Regulation No. 8 of 2021, and CoFTRA Regulation No. 11 of 2022. The crypto asset investment mechanism regulated in these laws and regulations is a form of preventive legal protection. In contrast, there is not a single CoFTRA Regulation that contains provisions on repressive legal protection for Investors suffering losses from uncertified Traders. However, Investors suffering losses from uncertified Traders can still take several legal actions: deliberation, civil lawsuit, and restorative justice on the criminal decision. Therefore, it is recommended for Investors to conduct crypto asset transactions with Traders by obtaining a registration certificate from CoFTRA. In addition, it is recommended to CoFTRA for more regulation on dispute resolution for Investors suffering losses from uncertified Traders. In this case, to create legal certainty and better legal protection in future crypto asset physical market trading.

Abstract:
This study examines and analyzes the legal subject of the Ujung Pandang Central Market management activities, which are treated as Non-Residential Condominium buildings based on Law No. 20 of 2011. This research combines normative juridical and empirical research methods. The primary data were collected using direct interviews, while the secondary data was collected using literature study techniques. The data obtained in this research were then analyzed qualitatively. The results show that the legal subject of the Ujung Pandang Central Market management activities, which are treated as Non-Residential Condominium buildings, must be held by PPPSRS based on Article 59 of Law No. 20 of 2011. In this case, if PPPSRS has not been established, then PT. MTIR must establish PPPSRS no later than one year from the first delivery of the condominium unit to the owner. However, until now, PPPSRS has not been established and established by PT. MTIR. So strictly speaking, PT. MTIR deviated from its obligations in implementing Law No. 20 of 2011. Therefore, it is recommended that the Makassar Municipal Government re-evaluate the involvement of PT. MTIR as Holder of The Right to Build for Ujung Pandang Central Market. In addition, it is recommended to PT. MTIR to comply with Article 59 of Law No. 20 of 2011 by establishing PPPSRS. Furthermore, it is hoped that law enforcement and the Regional House of Representatives of Makassar Municipal will protect the interests of traders so that PPPSRS is established as a legal subject for the Ujung Pandang Central Market management activities.

Abstract:
This study examines and analyzes the dispute resolution of appointing a legal guardian based on the audi et alteram partem principle and only one legal guardian principle. This research combines normative juridical and empirical research methods. The types and sources of data used in this research are primary and secondary data. The primary data were collected using direct interviews with an informant. While the secondary data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The data obtained in this research were then analyzed juridically qualitatively. The results show that implementing the dispute resolution of appointing a legal guardian through a lawsuit realizes the principle of audi et alteram partem. Furthermore, with the realization of the audi et alteram partem principle, it will also directly realize the principle of only one guardian or what is known as the principle of one and indivisible. Therefore, it is recommended that the Government make amendments to Government Regulation No. 29 of 2019. In this case, explicitly and regulated disputes over guardianship rights should be examined through the jurisdictio contentiosa mechanism. Thus, anyone has the right to apply as a legal guardian, as long as they meet the requirements, have closeness, and the Child’s willingness.

Abstract:
This research aims to determine the legal awareness of juveniles in archipelagic areas using social media. This type of research is empirical legal research. The data was collected using a questionnaire and direct interviews. The data obtained in this research were then analyzed descriptively qualitatively with a sociological juridical approach to conclude the research's object. The results show that most of the legal awareness of juveniles in archipelagic areas is still low using social media. In this case, most juveniles do not know (54%) and do not understand (66%) on regulations for using social media. In addition, most behaviors of juveniles have violated (72%) of the regulations for using social media. Therefore, it is recommended for parents, teachers, and law enforcement officers to provide assistance and education to juveniles in using social media. In addition, law enforcement and local government officials can involve the participation of the community to be more intense in conducting legal counseling for juveniles. In this case, juveniles in archipelagic areas will have more legal awareness and comply with laws and regulations in the future.

Abstract:
This study describes the standard clauses in the murabahah financing agreement. This study uses a normative juridical research method. The data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The collected legal material is then analyzed using qualitative data analysis methods, which will conclude the research’s object. The results show that there are 17 standard clauses and a prohibition of inclusion of the exclusion clause in the murabahah financing agreement. Therefore, it is recommended that the Bank and the Customer apply the standard clauses in the murabahah financing agreement. In this case, the Bank and the Customer get guarantees, comfort, and legal protection during the murabahah financing period.

Abstract:
This study examines the principles that can deter and eradicate gratification as part of the corruption crime. This study uses a normative juridical research method. The data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The collected legal material is then analyzed using qualitative data analysis methods, which will conclude the research's object. The results show that the deterrence and eradication of gratification crime have been regulated in Article 12 B and Article 12 C of Law No. 20 of 2001. In addition, this provision contains an encumbrance of reverse proof, which aims to simplify the process of proving illegal receipts and indications as a bribery crime for civil servants or state administrators. The principles in deterrence and eradication of gratification crime include legal certainty, transparency, accountability, public interest, proportionality, and respect for human rights. Therefore, it is recommended to CEC, civil servants or state administrators, and the community to practice the principles of deterrence and eradication of gratification crime. In this case, Indonesia can be released from the shackles of criminal acts of corruption in the future.

Abstract:
This study aims to examine and analyze the Judge’s application of imprisonment to kleptomaniacs based on Decision No. 574/Pid.B/2019/PN.Dps. This study uses a normative juridical research method. The data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The collected legal material is then analyzed using qualitative data analysis methods with a statute approach and a case approach which will then conclude the object of the research. The results show that the Judge’s application of imprisonment to the accused is based on Decision No. 574/Pid.B/2019/PN.Dps was the right decision. In this case, the problem of kleptomania currently ongoing in court should be proven with a Psychiatric Visum et Repertum. While the Letter of Statement No. 01/II.MR/RSPI/2019 cannot be the basis for the implementation of eliminating punishment. To determine that a person has kleptomania must undergo a process of examination for a minimum of two weeks to three months. Therefore, it is recommended that investigators provide the opportunity or take the initiative to prove the suspect’s mental condition before being processed to the following legal proof stage. So no more accused who prove their status as kleptomaniacs using the letter of statement. The Judge is also recommended to decide by giving measures sanction to the accused if proven to have kleptomania to avoid the recurrence of the crime of theft in the future.

Abstract:
This study aims to examine and analyze the cancellation of the transfer of land rights through oral grants. In addition, to understand the legal consequences of Decision No. 30/Pdt.G/2020/PN.Tnr regarding the position of the land object obtained against the law. This study uses a normative juridical research method. The data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The collected legal material is then analyzed using qualitative data analysis methods with a statute approach and a case approach which will then conclude the object of the research. The results show that the transfer of land rights is implemented through oral grants in Decision No. 30/Pdt.G/2020/PN.Tnr is invalid and null by law. In this case, based on Article 617, Article 1320, Article 1335, Article 1365, Article 1682, and Article 1688 point 2 of the Civil Code. In addition, there are rules and prohibitions for transferring land from the distribution of the Transmigration Program. While the legal consequences are defendants, I to VIII and co-defendant V must vacate and get out from the land right of ownership plaintiff in excellent and intact condition. Therefore, it is recommended that each party that implements the grant knows the rules according to the applicable laws and regulations. Meanwhile, the recipient of the distribution of Land from the Transmigration Program must understand the rules and prohibitions as a participant in the program. The government and related agencies must be more intense in socializing with the public about the importance of making a grant deed before the Land Deed Official. This condition aims to minimize the occurrence of land disputes in the future due to oral grants.

Abstract:
This study examines and analyzes grant deed cancellation in inheritance cases based on Decision No. 0492/Pdt.G/2020/PA.Klt. This study uses a normative juridical research method. The data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The collected legal material is then analyzed using qualitative data analysis methods with a statute approach and a case approach which will then conclude the object of the research. The results show that the cancellation of grant deeds in inheritance cases is based on Decision No. 0492/Pdt.G/2020/PA.Klt consists of several of the Judge’s considerations. First, Article 211 of the Compilation of Islamic Law regulates that grants from parents to their children can be equalized with inheritance. Second, Article 832 of the Civil Code and Article 174 section (1) of the Compilation of Islamic Law regulates that those entitled to become inheritors are blood-related families. Third, Article 841 and Article 842 of the Civil Code and Article 185 section (1) of the Compilation of Islamic Law regulates the rights transferred from inheritor to substitute inheritor. In addition, the transfer of the right from someone who dies to their inheritor applies automatically because of Allah’s provisions in Q.S. An-Nisa’ verse 7. Therefore, it is recommended for the plaintiffs and defendant to file a claim for certificate cancellation in the Administrative Courts. Proportionality of inheritance distribution: the defendant gets 3/6 inheritance, and three substitute inheritors each get 1/6 inheritance. Thus, the principle of justice can be felt and implemented by and for inheritance and substitute inheritors.

Abstract:
This study aims to analyze and explain the position of creditors as holders of the pledge of shares of a Limited Liability Company declared bankrupt. This study also aims to determine the legal remedies creditors can take if they experience these problems. This study uses a normative juridical research method with a statute and conceptual approach. The data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The collected legal materials are then analyzed using qualitative data analysis methods. The results show that the position of creditors as holders of the pledge of shares of a Limited Liability Company declared bankrupt is preferred creditors. However, the position of creditors will mutatis mutandis change from preferred creditors to concurrent creditors because the collateral object no longer exists. In addition, creditors can make efforts as holders of the pledge of shares related to Limited Liability Company declared bankrupt, namely preventive and repressive efforts. However, repressive efforts are insufficient to provide justice, certainty, and legal protection to creditors as holders of the pledge of shares. Therefore, it is recommended to creditors as holders of the pledge of shares to make preventive efforts: authentic deed, authorization letter to sell the collateral object, adding another collateral object, and auditing prospective debtors and collateral objects. In addition, it is recommended for the Government to harmonize and regulate several applicable laws and regulations regarding the pledge of shares. In this case, creditors as holders of the pledge of shares have more power, certainty, and legal protection in the pledge of shares agreement in the future.

Abstract:
This study aims to examine and analyze the legal due diligence approach to land acquisition for the public interest. In addition, to analyze aspects of legal due diligence as a preventive effort to minimize land acquisition problems. This research was conducted using a normative juridical approach with analytical descriptive specifications. The literature study was used to obtain the legal materials needed in this research. The collected legal materials are then analyzed using a qualitative descriptive analysis method. The results show that legal due diligence of land acquisition for the public interest has several objectives: obtaining legal status or legal clarity regarding land documents; checking the validity of the right of ownership to land; checking the legal compliance of land rights owners; providing an opinion for legal certainty of a policy taken by the Government. Furthermore, legal due diligence as a preventive effort to minimize land acquisition problems include: information and data must be valid, comprehensive, and objective; the transaction must be carried out in good faith; investigation and evaluate facts on relevant land objects based on research analysis. Therefore, it is recommended that the Government implement legal due diligence of land acquisition for the public interest as a preventive effort to suppress and minimize the risk of potential legal remedies such as lawsuits that will arise in the future.

Abstract:
This study aims to analyze the regulation on challenges and strategies to minimize campaign violations of the Regional Head Election simultaneously in 2020 during the Covid-19 pandemic. The research method used is normative juridical. Data was collected using literature study techniques on primary, secondary, and tertiary legal materials. The collected legal materials were then analyzed using qualitative data analysis methods. The results show that Law No. 6 of 2020, Regulation of General Election Commission No. 5 of 2020, Regulation of General Election Commission No. 13 of 2020, and Regulation of Election Supervisory Board No. 4 of 2020 has not been able to address the various violations of the 2020 Regional Head Elections campaign during the Covid-19 pandemic. In this case, mass mobilization exceeds the amount determined based on Regulation of General Election Commission No. 13 of 2020. In addition, the massive role of political buzzers indicates that money politics is rarely absent during the Regional Head Election campaign. Therefore, it is recommended to establish special regulations for pandemic situations, including prohibiting donations or other money politics. Furthermore, the involvement of political buzzers in online media who often use anonymous accounts requires specific regulations, including account legalization, content configuration, and content narrative. In addition, the application of health protocols in the Regional Head Election campaign should be based on Law No. 6 of 2018, which contains strict sanctions for violators of health protocols. From these recommendations, it is hoped that it will minimize the campaign violations of the Regional Head Election simultaneously in the future.

Abstract:
This study aims to determine the Government’s strategy in making regulations related to health problems and economic problems for the community. In addition, this study also wants to know the impact of Makassar Municipality’s strategy in implementing regulations to increase the productivity and competitiveness of the community and business actors during the Covid-19 pandemic. This study uses two types of research: normative research and empirical research. In-depth interviews, literature review, and documentation are data collection techniques used in this research. The data that has been collected is then processed and analyzed using qualitative descriptive analysis techniques. The results show that the Government’s priority in dealing with the Covid-19 problem is establishing Government Regulation No. 21 of 2020 to address national health issues. Meanwhile, the Government’s priority in dealing with community economic problems is establishing Law No. 7 of 2021. In this case, the Government relaxes VAT payments and SPT reporting to individuals and business actors. Furthermore, the impact of the Mayoral Regulation of Makassar Municipality No. 51 of 2020 is the decline in people’s economic income during the Covid-19 pandemic. However, with the Mayoral Regulation of Makassar Municipality No. 51 of 2020, people can still carry out economic activities by complying with health protocols. Therefore, it is recommended that the people of Makassar Municipal continue to carry out economic activities by complying with health protocols even though they are currently entering the new normal period. In addition, business actors who have received relaxation of VAT payments and SPT reporting and their businesses have reached a stable condition to fulfill their obligations again by paying taxes. Paying taxes is a form of community participation in national development.

Abstract:
This study aims to examine and analyze the legality of granting by Singaporean citizens to Indonesian citizens before the Notary Public of Singapore on land objects located in the territory of Indonesia based on Decision No. 912/Pdt.G/2018/PA.Jmb. In addition, this study further analyzes the laws and regulations that should apply in handling grants case based on international civil law. This research was conducted using a normative juridical approach with analytical descriptive specifications. The literature study was used to obtain the legal materials needed in this research. The collected legal material is then analyzed using qualitative data analysis methods with a statute and case approach. The results show that the legality of granting the object of land wills in Indonesia from former Indonesian citizens who have become foreign citizens to Indonesian citizens based on Decision No. 912/Pdt.G/2018/PA.Jmb is invalid and void by law. This case is contrary to Article 21 section (3) of Law No. 5 of 1960 and Article 37 section (1) of Government Regulation No. 24 of 1997. Based on the concept of International Civil Law, that action can be categorized as law smuggling, namely an act committed in a foreign country and recognized as legal in that foreign country. As for immovable objects, the general principle accepted in international civil law has stated that immovable objects in their status are based on the principle of lex situs or lex rei sitae. Therefore, it is recommended that every foreign citizen who has land rights or other property rights in Indonesia must relinquish the right of ownership within one year. The granting of land rights or property rights must be made in the grant agreement before the Land Deed Official of Indonesia. Furthermore, the registration of the transfer of land rights will be carried out at the National Land Agency of the Republic of Indonesia. Thus, land rights or property rights will get guarantees, protection, and legal certainty to avoid disputes in the future.

Abstract:
This study aims to examine and analyze the effect of determining adult status in Law No. 16 of 2019 against adult status in Islamic law and positive law in Indonesia. This research was conducted using a normative juridical approach with analytical descriptive specifications. Literature study was used to obtain the legal materials needed in this research. The legal materials that have been collected are then analyzed using hermeneutic analysis and interpretation methods. The results show that determining adult status is a preventive effort from the Government to avoid discrimination or prevent the deprivation of rights for children. Therefore, it is recommended that all parents continue to provide incentive supervision to their children until their children reach adulthood. In this case, the child avoids promiscuity so that there is no marriage by accident. In addition, it is recommended to the public not to carry out forced marriages and the practice of child marriage which is part of the Indigenous Peoples Law. Furthermore, it is suggested that the Indonesian Ulema amend the KHI, and the Government subsequently enacted it in laws and regulations.

Abstract:
This study aims to determine the effect of halal certification labels on the sale of culinary products in Palembang. Furthermore, this study also wants to know the competitiveness of business actors who have halal certification in Palembang. In addition, to determine the perception of non-Muslim tourists on halal product certification in Palembang. This type of study is empirical research. The questionnaire method was used to obtain research data. The data obtained in this study refer to the problem hypothesis testing. Bivariate linear regression was used as a test tool on the halal label variable to predict an increase in sales and competitiveness and was calculated by SPSS 22. At the same time, explanatory sequential design as a qualitative analysis method is obtained from the description of the questionnaire data. It is used to explain non-Muslim perceptions of halal products. The results of this study indicate several conclusions. First, the sale of culinary products has increased positively with the existence of halal certification labels. In this case, halal certification labels affect the sale of culinary products in Palembang is 19.1%. Second, the competitiveness of business actors has increased positively with halal certification labels. In this case, halal certification labels affect the competitiveness of business actors in Palembang is 8.2%. Third, most non-Muslim tourists have a good perception of the halalness of culinary products in Palembang. In this case, 94.31% of respondents have a good perception of the halalness of a culinary product. Meanwhile, 5.69% of respondents have a bad perception. Therefore, it is recommended for socialization related to the role of halal certificate labels to the general public and culinary business actors in Palembang. In addition, a collaboration between the Association, Community, Government, and Media is needed to encourage culinary business actors in Palembang to play an active role in having a halal certificate label. Next, invite BPJPH to provide information about the steps for registering a halal certificate label.

Abstract:
This study aims to examine and analyze inheritance dispute resolution related to the position of adopted son based on Batak Toba indigenous law. This research was conducted using a normative juridical approach with analytical descriptive specifications. The data obtained were then analyzed using qualitative juridical methods. The results show that the indigenous inheritance law positions the adopted son on par with the biological son. Suppose there is an inheritance dispute between the adopted son and the biological child. In that case, the inheritance dispute resolution based on the Batak Toba indigenous law can go through three stages: family deliberation, indigenous institutions, and the courts are the final stage or step that must be chosen. Most of the Batak Toba indigenous people choose dispute resolution through indigenous institutions. In this case, the chance of failure of agreement in dispute resolution through indigenous institutions is tiny because indigenous institutions involve indigenous leaders who understand and control the Batak Toba indigenous law. Therefore, it is recommended to all Batak Toba indigenous people who are in dispute to carry out a resolution through three stages based on the Batak Toba indigenous law. In addition, it is hoped that all Batak Toba indigenous community elements will supervise the implementation of dispute resolution decisions, considering that Batak Toba indigenous people prioritize and uphold the values of kinship and peace in dispute resolution.

Abstract:
This study aims to determine that TVI Express members get rights as consumers based on the perspective of consumer protection. This type of research is empirical legal research. The interview method was used to obtain research data. The data obtained in this study were then analyzed qualitatively. The results show that TVI Express members do not get rights as consumers based on the perspective of consumer protection. The rights that TVI Express members do not obtain are the right to correct, transparent, and honest information regarding the conditions and guarantees of TVI Express products. In addition, TVI Express members did not get the right to have their opinions and complaints heard on TVI Express service products that could not be used. Furthermore, TVI Express members do not get the right to obtain compensation or replacement from TVI Express. Therefore, it is recommended that legal certainty on consumer protection for TVI Express members can be realized. In this case, practical steps are needed from the government, especially BPSK, to take firm action against TVI Express business actors. In addition, it takes an active role from the community to continue to provide information and complaints if they feel the MLM business has harmed them. In this case, the government, especially BPSK, can suppress the MLM business to be responsible to its members and consumers.

Abstract:
This study aims to determine the position and authority of Law No. 16 of 2019 in responding to interfaith marriages abroad. The type of legal research used is a dogmatic juridical research method. The data collection in this study was carried out through a literature study of laws and regulations, journals, research results, and books. This study uses hermeneutic analysis and interpretation methods to analyze the data used in this study. The study results show that interfaith marriage is not justified in all scriptures recognized in Indonesia. Couples who want to have interfaith marriages can hold them abroad. Meanwhile, from the state’s point of view, interfaith marriages are inconsistent. In this case, Law No. 16 of 2019 does not justify interfaith marriage, while Law No. 24 of 2013 can determine the marital status of interfaith abroad. So that the legal certainty of interfaith marriages is not based on Law No. 16 of 2019 but Law No. 24 of 2013. Therefore, it is suggested that the government amend Law No. 16 of 2019. In this case, it contains norms that legitimize interfaith marriages as regulated in Law No. 24 of 2013. If Law No. 16 of 2019 is considered still relevant to the socio-cultural conditions of Indonesia, the government must amend Law No. 24 of 2013. In this case, it is removing norms that legitimize interfaith marriages. The amendments to the legislation attempt to resolve inconsistencies in the legislation related to interfaith marriages.

Abstract:
This study aims to explain the theory position in the structure of legal science. This research is a normative legal research. The data collection technique used is literature study. The data that has been collected is then processed in a qualitative descriptive manner, then described in a narrative manner. The results of the study indicate that legal theory is one of the theoretical disciplines, whose object of study is law in a broad sense. The legal theory does not study law in a dogmatic definition and does not examine law in a positive law sense but explores legal science in a broader sense. The legal theory examines legal science from a critical, concrete, and analytical perspective so that the approach is interdisciplinary and multidisciplinary. Legal theory is a more in-depth approach to legal science in positive legal science approaches and legal dogmatics. Therefore, legal theory is positioned as a meta-theory of the science of law theory as a positive legal theory and legal dogmatics.

Abstract:
This study aims to understand custom as a key concept and siri’ as the core concept of Ugi-Mangkasara Culture based on a legal anthropological perspective. This study uses a normative approach that focuses on tracing the history of customary law related to the object of the problem. The object of study in this research is documents and manuscripts about Ugi-Mangkasara culture. The analysis used is a qualitative analysis based on the perspective of legal anthropology, so that the object of study can be interpreted and described in a narrative form. The study results show that custom as a key concept and siri’ as the core concept of Ugi-Mangkasara culture is a product of the culture of the Ugi-Mangkasara human child, which is full of values from various dimensions as the identity of the Ugi-Mangkasara human child. For Ugi-Mangkasara human children, respecting customs is a social obligation of the culture owner. Enforcing siri’ is respect for self-respect and human dignity. The values contained in the Ugi-Mangkasara culture can be used as a spirit for human children who own the culture in particular and in general for Indonesian children as part of the Ugi-Mangkasara tribe.

Abstract:
This study aims to analyze and understand the legal protection towards the mark owner from the share-in jar cosmetic trade and the legal consequences for business actors who do share-in jar cosmetic trade. The type of legal research used in this study is a normative juridical legal research method. The data collection in this study was conducted through a literature study from the laws and regulations, journals, research results, and books. The data analysis used in this research is the descriptive analysis method. The results of the study show that the legal protection towards the mark owner from the share-in jar cosmetic trade can be carried out through preventive and repressive legal protection efforts. Legal protection efforts are preventively carried out by registering the mark to get legal protection as a legal mark owner. Repressive legal protection efforts for trademarks can be done by litigation dispute resolution and non-litigation dispute resolution. The legal consequences for business actors who do share-in jar cosmetic trade are compensate for damages and/or ceasing all acts related to mark use. Therefore, it is recommended to the mark owner to provide cosmetics with trial or sample sizes. In this case, so that consumers try first about their compatibility with these cosmetics. On the other hand, business actors doing share-in cosmetic jar trade must make a license agreement with the mark owner. Furthermore, the government needs to include criteria for violations of right on mark in laws and regulations. This is purpose to increase legal protection towards the mark owner from the share-in jar cosmetic trade in the future.

Abstract:
Penelitian ini bertujuan untuk menganalisis kedudukan Penyidik Pegawai Negeri Sipil Direktorat Jenderal Pajak dalam kerangka pemberantasan tindak pidana perpajakan. Penelitian ini menggunakan pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Metode analisis data yang digunakan dalam penelitian ini adalah analisis kualitatif. Hasil penelitian menunjukkan bahwa kedudukan Penyidik Pegawai Negeri Sipil Direktorat Jenderal Pajak dalam kerangka pemberantasan tindak pidana perpajakan ditekankan sebagai penyidik utama. Kedudukan tersebut sebagaimana berdasarkan UU No. 16 Tahun 2009 sebagai lex specialis derogat legi generalis terhadap UU No. 8 Tahun 1981. Adapun beberapa pergesekan antara PPNS DJP dengan instansi lainnya dapat dilihat dalam beberapa kasus. Misalnya kasus PPNS DJP Kanwil Sumbar-Jambi yang ditetapkan sebagai tersangka oleh Polri, serta kasus restitusi pajak Mobile 8 yang ditangani oleh Penyidik Kejaksaan. Salah satu faktor penyebab gesekan tersebut adalah perbedaan budaya organisasi masing-masing instansi terkait. Oleh karena itu, disarankan agar setiap institusi harus memahami dengan seksama apa fungsi utamanya dalam menangani tindak pidana perpajakan sehingga tidak terjadi kesalahpahaman dan potensi overlapping antar institusi yang dapat mengganggu proses penegakan hukum. Perbedaan budaya antar institusi yang menghasilkan egosentrisme harus dikesampingkan. Salah satu solusi terkait egosentrisme adalah setiap instansi terkait membuat kerjasama dengan melalui MoU sehingga setiap institusi terkait dapat saling memahami budaya antar organisasi.

Penelitian ini bertujuan untuk mengetahui kedudukan instrumen hukum administrasi dalam pembentukan kebijakan publik, serta menganalisis perkembangan dan urgensi hukum administrasi sebagai alternatif kebijakan pemerintah pada masa pandemi Covid-19. Tipe penelitian yang digunakan dalam penelitian ini adalah normatif-yuridis dengan spesifikasi bersifat deskriptif-analitis. Teknik analisis dilakukan secara kualitatif guna menjawab permasalahan hukum yang dihadapi. Kesimpulan penelitian ini adalah, sejak penetapan UU No. 2 Tahun 2020, hukum administrasi berkembang cepat selama pandemi Covid-19 berdasarkan beberapa indikator. Saran dalam penelitian ini adalah perlu dibentuk instrumen hukum yang materi muatannya berlaku sekali selesai agar tidak terjadi residu aturan.

Abstract:
Salah satu resiko yang harus disikapi oleh perbankan adalah tindak pidana transaksi ilegal menggunakan kartu ATM milik orang lain, dimana nantinya nasabah tidak mengetahui bahwa saldo di rekeningnya telah habis karena telah terjadi penarikan menggunakan kartu ATM hasil kloning. Oleh karena itu, penelitian ini bertujuan untuk menguraikan penerapan hukum terhadap transaksi illegal menggunakan kartu ATM milik orang lain, dan perlindungan hukum terhadap nasabah sebagai korban tindak pidana transaksi ilegal menggunakan kartu ATM hasil kloning. Penelitian ini menggunakan pendekatan yuridis normatif. Adapun metode analisis dilakukan dengan cara mengidentifikasi secara sistematis, dipolarisasi, dikategorisasi dan dikelompokkan sesuai dengan alur pembahasan dalam penelitian ini. Hasil penelitian menunjukkan bahwa penerapan hukum terhadap transaksi illegal menggunakan kartu ATM milik orang lain, diatur berdasarkan UU No. 1 Tahun 1960 dan UU No. 19 Tahun 2016. Akan tetapi, tindak pidana transaksi illegal menggunakan kartu ATM milik orang lain, belum diatur secara tegas di Indonesia apabila dibandingkan dengan Singapura dan Jepang. Adapun perlindungan hukum terhadap nasabah sebagai korban tindak pidana transaksi ilegal menggunakan kartu ATM hasil kloning, dapat diketahui berdasarkan beberapa peraturan perundang-undangan, antara lain UU No. 21 Tahun 2011, PBI No. 16/1/PBI/2014, POJK No. 1/POJK.07/2013, serta POJK No. 18/POJK.07/2018. Selain berdasarkan peraturan perundang-undangan, Dengan dasar kesimpulan tersebut, diharapkan secara tegas dapat dibentuk Undang-Undang tentang tindak pidana transaksi ilegal. Selain itu, Bank selaku PUJK harus membuat kebijakan penggunaan kartu ATM dengan teknologi chip implant, serta penerapan OTP sebagai autentikasi dua faktor (two-factor authentication) kepada para nasabahnya, sehingga risiko tindak pidana transaksi ilegal menggunakan kartu ATM milik orang lain dapat diminimalisir.

Abstract:
Penelitian ini bertujuan untuk menganalisis aspek perbandingan hukum terkait pembentukan pasal penghinaan terhadap peradilan, perzinahan, dan santet dalam RKUHP Indonesia. Penelitian ini menggunakan metode penelitian yuridis normatif dengan spesifikasi bersifat deskriptif. Adapun metode analisis yang digunakan dalam penelitian ini adalah analisis perbandingan hukum. Perbandingan hukum dilakukan untuk mengetahui persamaan dan perbedaan unsur dari setiap sistem hukum, sehingga dapat menjadi alternatif dalam menyikapi persoalan-persoalan tertentu. Hasil penelitian menunjukkan bahwa Indonesia menganut civil law system sebagai warisan dari Belanda. Akan tetapi, tidak ada lagi negara yang murni menganut civil law system atau common law system. Perpaduan antara civil law system dan common law system di Indonesia disertai pula dengan perpaduan antara unsur hukum agama dan hukum adat. Hal ini dapat diketahui dari aspek perbandingan hukum terkait pembentukan pasal penghinaan terhadap peradilan, perzinahan, dan santet dalam RKUHP Indonesia. Tindak pidana penghinaan terhadap peradilan atau contempt of court dirumuskan dalam Pasal 302-325 RKUHP, dimana muatan dari Pasal tersebut merupakan perpaduan dari common law system. Tindak pidana perzinahan dirumuskan dalam Pasal 418 RKUHP, dimana muatan dari Pasal tersebut merupakan perpaduan dari hukum agama yang ditransformasikan ke dalam sistem hukum Indonesia yang menganut civil law system. Tindak pidana delik santet dirumuskan dalam Pasal 252 RKUHP, dimana muatan dari Pasal tersebut merupakan perpaduan antara sistem hukum adat dengan sistem hukum agama yang berusaha diterapkan ke dalam sistem hukum Indonesia. Olehnya itu, disarankan agar peran perbandingan hukum dalam menelaah proses pembaharuan hukum harus terus dilakukan, sehingga sistem hukum di Indonesia terus bergerak ke arah yang lebih baik.

Penelitian ini bertujuan untuk menguraikan upaya hukum bagi para terdakwa atau terpidana sebagai bentuk persamaan di hadapan hukum berdasarkan peraturan perundang-undangan. Metode yang digunakan dalam penelitian ini adalah metode penelitian yuridis normatif yang bersifat deskriptif kualitatif. Teknik pengumpulan bahan hukum dalam penelitian ini adalah teknik studi kepustakaan. Adapun metode analisis dilakukan dengan cara mengidentifikasi secara sistematis serta menghubungkan antar ketentuan yang terdapat dalam bahan hukum primer. Hasil penelitian menunjukkan bahwa upaya hukum bagi para terdakwa atau terpidana sebagai bentuk persamaan di hadapan hukum berdasarkan peraturan perundang-undangan, terdiri dari upaya hukum biasa dan upaya hukum luar biasa. Adapun upaya hukum biasa, meliputi perlawanan, banding, dan kasasi. Sedangkan upaya hukum luar biasa, meliputi pemeriksaan kasasi demi kepentingan hukum dan peninjauan kembali. Upaya hukum juga merupakan manifestasi dari fungsi hukum, dimana untuk melindungi manusia dalam masyarakat, bangsa, dan negara. Selain itu baik jiwa dan raga maupun hak individu yaitu hak asasinya, hak kebendaanya, maupun hak perorangannya. Disarankan agar baik aparat penyelenggara hukum maupun masyarakat, khususnya para pelaku tindak pidana agar memahami hak dan kewajiban yang telah diatur dalam UU No. 8 Tahun 1981, UU No. 3 Tahun 2009, dan UU No. 48 Tahun 2009 terkait perlindungan hukum terhadap pelaku tindak pidana berdasarkan sistem peradilan pidana Indonesia.

Hasil penelitian menunjukkan bahwa pemberlakuan parliamentary threshold dalam sistem Pemilu di Indonesia bertentangan dengan konsep kedaulatan rakyat. Adapun penerapan sistem khususnya pada Pemilu 2024, patut mempertimbangkan sistem Campuran sebagai alternatif dari sistem Representasi Proporsional yang selama ini diterapkan pada Pemilu di Indonesia. Selanjutnya, dibutuhkan formulasi khusus dimana Partai Politik Peserta Pemilu yang dinyatakan tidak memenuhi ambang batas dapat menempuh jalur koalisi untuk mencapai ambang batas, bahkan sampai pada pilihan untuk meniadakan parliamentary threshold (ambang batas perolehan suara 0%). Hal ini akan menjadi jalan tengah atas kebutuhan pencapaian proporsionalitas sistem Pemilu, sebagai bentuk akomodasi suara pemilih serta kepastian hukum atas kedaulatan rakyat, serta kebutuhan menciptakan sistem Presidensialisme yang semakin efektif di masa yang akan datang

Abstract:
Penelitian ini bertujuan untuk mengetahui hak dan kewajiban pemberi hibah yang melakukan pembatalan hibah; akibat hukum terhadap penerima hibah yang kepadanya terjadi pembatalan hibah; serta untuk menganalisis kesesuaian Putusan PN Pematangsiantar No. 33/Pdt.G/2019/PN.Pms dengan ketentuan Perundang-undangan yang berlaku. Jenis penelitian yang digunakan penelitian ini adalah penelitian hukum normatif, dan bersifat deskriptif. Teknik pengumpulan data yang digunakan adalah studi kepustakaan (library research) dan studi dokumen. Adapun teknik analisis data yang digunakan adalah teknik analisis data kualitatif. Hasil penelitian menunjukkan bahwa Pemberi hibah memiliki beberapa hak sebagaimana berdasarkan Pasal 1669, Pasal 1671, dan Pasal 1672 KUHPerdata. Pemberi hibah juga dapat menarik kembali pemberiannya, jika penerima hibah tidak memenuhi kewajiban yang ditentukan dalam akta hibah atau hal-hal lain, sebagaimana berdasarkan Pasal 1688 KUHPerdata. Selanjutnya, akibat hukum terhadap penerima hibah yang kepadanya terjadi pembatalan hibah ialah pengembalian objek hibah dalam keadaan semula sebelum dibuat perjanjian, sebagaimana berdasarkan Pasal 1691 KUHPerdata, dan disertai putusan yang berketetapan hukum tetap. Adapun mengenai Putusan PN Pematangsiantar No. 33/Pdt.G/2019/PN.Pms, dapat disimpulkan bahwa keputusan tersebut telah sesuai dengan peraturan perundang-undangan yang berlaku.

Abstract:
Penelitian ini bertujuan untuk mengurai strategi beberapa negara, serta menganalisis keberlakuan instrumen hukum internasional dalam menyikapi marine pollution. Penelitian ini menggunakan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach) dimana jenis dan sumber data yaitu terdiri dari bahan hukum primer dan sekunder. Selanjutnya, sumber data yang telah dikumpulkan akan diidentifikasi, klasifikasi dan sistematisasi sesuai permasalahan penelitian. Analisis data dalam penelitian ini dilakukan melalui cara menelaah sumber ataupun bahan hukum tertulis. Hasil telaah tersebut diinterpretasikan menggunakan metode interpretasi yang sistematis, gramatikal, dan, teleologis. Hasil penelitian menguraikan bahwa strategi dalam menyikapi marine pollution, terdiri dari empat negara, antara lain Australia memilih untuk meningkatkan pemahaman masyarakat terkait lingkungan di laut. Indonesia memilih untuk membuat payung hukum serta mendorong pemanfaatan sampah plastik sebagai campuran aspal. Amerika memilih untuk memprioritaskan peraturan perundang-undangan, antara lain Public Law Nomor 92-500 Tahun 1972 tentang Federal Water Pollution Control Act Amendments of 1972 dan Public Law Nomor 109-449 Tahun 2006 tentang Marine Debris Research, Prevention, and Reduction Act. Jepang melalui Kementerian Lingkungan Hidup memilih untuk melakukan pembersihan di lautan, serta memberlakukan kepada masyarakat terkait daur ulang sampah. Lebih lanjut, instrumen hukum internasional dalam menyikapi marine pollution, antara lain Protocol 1996 dan UNCLOS, serta Protocol MARPOL. Protocol 1996 dan UNCLOS saling berkaitan dan tidak bisa dipisahkan, namun sebagian belum meratifikasi Protocol MARPOL sebagai bagian dari pelaksana Protocol 1996. Adapun saran-saran dalam menyikapi marine pollution secara umum, antara lain pertama, memberikan edukasi kepada masyarakat internasional agar membentuk kepeduliannya terhadap lingkungan laut. Kedua, meratifikasi instrumen hukum internasional terkait marine pollution sehingga terjadi sinkronisasi dan harmonisasi hukum yang dapat dipertanggungjawabkan oleh seluruh masyarakat internasional. Dengan demikian, strategi mengatasi marine pollution dapat diatasi melalui keterhubungan antara perbandingan praktik negara dan instrumen hukum internasional.

Abstract:
This study aims to analyze the status of dual citizenship in terms of Law Number 12 of 2006 on Citizenship of the Republic of Indonesia. This research uses normative legal research methods. Normative legal research is research conducted by conducting a study of statutory regulations, namely Law Number 12 of 2006 on Citizenship of the Republic of Indonesia, whether it is relevant to be applied to a legal problem. The legal problem in this study is the citizenship status of Gloria Natapradja. In 2016, Gloria Natapradja was dismissed as an official of the Heirloom Flag raiser after having French citizenship, who followed the citizenship of her biological father. After conducting research, it is known, the state has an obligation to protect the rights of citizens. The state should pay attention and protect citizens regarding the status of citizens. The problems experienced by Gloria Natapradja, because citizenship status can be seen as not yet the maximum role of the government to protect citizens. The issue of citizenship in Gloria Natapradja requires the government to review the regulation of citizenship status as regulated in Law Number 12 of 2006 on Citizenship of the Republic of Indonesia.

Abstract:
Penelitian ini bertujuan untuk mengetahui pertimbangan Hakim dalam menjatuhkan putusan terhadap pegawai negeri sipil yang melakukan tindak pidana korupsi, serta untuk mengetahui penerapan kebijakan hukum terhadap pegawai negeri sipil yang melakukan tindak pidana korupsi. Penelitian ini menggunakan metode penelitian hukum normatif, yaitu suatu prosedur penelitian ilmiah untuk menemukan kebenaran berdasarkan logika keilmuan hukum, melalui sisi normatifnya. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan kasus. Data yang digunakan dalam penelitian ini adalah data primer dan data sekunder. Data primer dalam penelitian ini berupa Putusan Pengadilan Negeri Medan Nomor: 73/Pid.Sus-TPK/2018/PN.Mdn. Sedangkan data sekunder diperoleh melalui berbagai referensi, yaitu peraturan perundang-undangan, serta bahan-bahan kepustakaan yang berkaitan dengan permasalahan penelitian dan juga memiliki koherensi dengan data primer. Teknik pengumpulan data yang digunakan dalam penelitian ini adalah; studi kepustakaan (library research), dan studi dokumen (document research). Adapun teknik analisis data yang digunakan adalah teknik analisis data kualitatif. Hasil penelitian menunjukkan bahwa pertimbangan Hakim didasari oleh ketentuan peraturan perundang-undangan. Melalui putusan yang dijatuhkan, Majelis Hakim berusaha mewujudkan negara yang bebas dan bersih dari korupsi, kolusi, dan nepotisme. Adapun penerapan kebijakan hukum terhadap pegawai negeri sipil yang melakukan tindak pidana korupsi oleh Majelis Hakim ialah tidak membedakan status sosial, meskipun terdakwa adalah seorang pegawai negeri sipil. Kebijakan hukum tersebut sesuai dengan pasal pelanggaran yang dikenai kepada terdakwa.

Abstract:
Penelitian ini bertujuan untuk mendeskripsikan ketentuan implementasi Prinsip Subrogasi di dalam Perjanjian Asuransi Kendaraan Bermotor; hal-hal yang menjadi hambatan pihak tertanggung dalam pengajuan klaim; serta tanggungjawab PT Pan Pacific Insurance mengenai prinsip subrogasi atas kerugian yang disebabkan oleh keterlibatan pihak ketiga. Untuk mencapai tujuan tersebut, penelitian ini menggunakan pendekatan yuridis-normatif yang dilaksanakan dengan berdasar pada tinjauan bahan pustaka atau data sekunder. Selain itu, penelitian ini juga dipertajam dengan metode penelitian studi empiris yang biasa pula disebut dengan penelitian hukum sosiologis. Adapun jenis penelitian ini adalah deskriptif analisis, dengan jenis data yang terdiri dari 2 (dua), yakni data primer dan data sekunder. Sedangkan teknik analisis data yang digunakan dalam penelitian ini adalah teknik analisis data kualitatif. Hasil penelitian menunjukan bahwa PT Pan Pacific Insurance sama halnya dengan perusahaan asuransi pada umumnya dalam pengaplikasian asuransi, dimana menawarkan prinsip subrogasi sebagai salah satu dasar dalam pengaplikasian asuransi. Dalam pelaksanaannya, terdapat berbagai hambatan yang berasal dari perusahaan asuransi sendiri maupun pihak tertanggung. Tanggung jawab perusahaan asuransi atas klaim ganti rugi, sesuai dengan nilai limit nominal pertanggung. Dengan demikian, maka sisa kekurangan dari biaya perbaikan terhadap objek asuransi ditanggung oleh pihak ketiga sesuai dengan kesepakatannya bersama pihak tertanggung.

Abstract:
Penelitian ini bertujuan untuk menganalisis efektivitas pengamanan Intelijen Kepolisian terhadap putusan pengadilan atas objek sengketa di Provinsi Sulawesi Selatan. Penelitian ini menggunakan metode penelitian studi empiris yang biasa pula disebut dengan penelitian hukum sosiologis, karena melihat penerapan hukum sebagai suatu kondisi faktual di lingkungan sosial dan hubungannya terhadap norma hukum. Penelitian ini dilakukan di Provinsi Sulawesi Selatan, dengan jumlah responden sebanyak 92 orang. Analisis data dalam penelitian ini menggunakan pendekatan kualitatif, dimana mengolah output dari kuesioner, dan disajikan dalam bentuk tabulasi frekuensi (F) dan distribusi persentasi (%). Hasil penelitian menunjukan bahwa pengamanan Ditintelkam Polda Sulawesi Selatan terhadap proses eksekusi atas objek sengketa di Provinsi Sulawesi Selatan berdasarkan Perkap BIN No. 2 Tahun 2013, dapat dinilai dari lima aspek, antara lain: Sasaran Pengamanan; Pelaksanaan Pengamanan; Koordinasi dan Administrasi; serta Pengawasan dan Pengendalian. Perolehan data dari keseluruhan indikator berdasarkan aspek-aspek pengamanan Ditintelkam Polda Sulawesi Selatan menunjukkan hasil yang kurang efektif. Dibutuhkan keseriusan dalam meningkatkan efektivitas pengamanan Ditintelkam Polda Sulawesi Selatan guna memastikan proses eksekusi putusan pengadilan atas objek sengketa bisa lebih efektif di masa akan datang.

Abstract:
Penelitian ini bertujuan untuk menganalisis penyebab restrukturisasi utang Perseroan Terbatas yang tidak diatur secara jelas dalam UU No. 37 Tahun 2004. Lebih lanjut, penelitian ini juga akan menganalisis terkait upaya yang dapat dilakukan oleh Perseroan Terbatas dalam menyelamatkan perusahaannya apabila restrukturisasi utang tidak tercapai. Penelitian ini menggunakan pendekatan hukum normatif (legal research) dimana melakukan penelusuran bahan-bahan hukum yang relevan dengan objek penelitian, dan ditunjang dengan wawancara kurator dimana advokat sebagai narasumber. Analisis data dalam penelitian ini menggunakan analisis kualitatif, setelah data dianalisis dan dibahas, kemudian ditarik kesimpulan dengan metode deduktif. Hasil penelitian menunjukan bahwa UU No. 37 Tahun 2004 tidak mengatur tentang restrukturisasi utang Perseroan Terbatas karena adanya prinsip kebebasan berkontrak dalam ketentuan umum perdata. Hal ini dapat mengakibatkan Debitor yang beritikad baik dan memiliki jumlah aset yang lebih besar dibandingkan utangnya namun tidak diberikan keringanan oleh Kreditor, salah satunya dengan memberikan jangka waktu pembayaran yang sangat pendek sehingga akan mengakibatkan Perseroan Terbatas Debitor tetap pailit. Perjanjian perdamaian akan menguntungkan Kreditor dari sisi ekonomi karena posisi Kreditor lebih kuat, sedangkan akan merugikan Debitor karena berada pada posisi yang lemah dikarenakan dihadapkan pada bentuk dan isi perjanjian yang sebenarnya tidak dikehendaki oleh Debitor tetapi terpaksa disetujui karena sudah tidak ada pilihan lagi baginya untuk mengemukakan suatu alternatif karena isi dalam perjanjian harus mengikuti kehendak dari kreditor. Adapun UU No. 37 Tahun 2004 tidak memberikan Kesempatan bagi Debitor untuk melakukan upaya lain, misalnya melakukan gugatan perdata umum ke pengadilan negeri dengan alasan adanya penyalahgunaan keadaan yang telah dilakukan oleh Kreditor dalam perjanjian perdamaian tersebut.

Abstract:
Penelitian ini bertujuan untuk mengetahui dan memahami faktor-faktor apakah yang mempengaruhi efektivitas pembagian harta bersama pasca perceraian studi kasus perkawinan poligami di Pengadilan Agama kelas 1A Makassar. Penelitian ini menggunakan tipe penelitian hukum empiris atau (Socio Legal Study Research). Penelitian ini dilakukan di Kota Makassar. Hasil penelitian menunjukan bahwa efektivitas pembagian harta bersama pasca perceraian studi kasus perkawinan poligami dapat dilihat berdasarkan lima faktor, antara lain: faktor hukumnya; faktor penegakan hukum; faktor sarana atau fasilitas pendukung; faktor masyarakat; serta faktor kebudayaan. Perolehan data dari keseluruhan faktor menunjukkan hasil yang kurang efektif, antara lain: terdapat 65% terkait faktor hukumnya; 72,5% terkait faktor penegakan hukumnya; 60% terkait faktor sarana atau fasilitas pendukung; 61,25% terkait faktor masyarakat; serta 62,5% terkait faktor kebudayaan.

Abstract:
Penelitian ini bertujuan untuk menganalisis Kekuasaan Kehakiman dalam putusan hakim terhadap pemberian sanksi di bawah batas minimal pada tindak pidana narkotika berdasarkan Pasal 112 UU No. 35 Tahun 2009 di Pengadilan Negeri Makassar sejak tiga bulan terakhir. Penelitian ini menggunakan metode penelitian normatif empiris dimana merupakan metode yang menggabungkan antara pendekatan hukum normatif dengan penelitian studi empiris. Hasil penelitian menunjukan bahwa Negara hukum bertujuan mewujudkan kepastian hukum dalam masyarakat, dimana setiap tindak kejahatan termasuk tindak pidana narkotika sebagai bagian dari Tindak Pidana Luar Biasa (Extra Ordinary Crime) akan diberikan putusan oleh hakim berdasarkan UU yang mengaturnya. Sehingga hakim dalam memberikan pertimbangan putusan tindak pidana narkotika, tidak boleh keluar dari ketentuan yang telah diatur dalam UU No. 35 Tahun 2009. Akan tetapi, terdapat putusan hakim terhadap pemberian sanksi di bawah batas minimal pada tindak pidana narkotika berdasarkan Pasal 112 UU No. 35 Tahun 2009 di Pengadilan Negeri Makassar sejak tiga bulan terakhir. Sehingga dalam hal ini hakim telah menciderai asas-asas pembentukan UU No. 35 Tahun 2009 juga mengabaikan upaya pemberantasan tindak pidana narkotika sebagai bagian dari Tindak Pidana Luar Biasa (Extra Ordinary Crime). Diharapkan Mahkamah Agung lebih responsif dalam meninjau setiap putusan hakim di Pengadilan Negeri. Hal itu diperlukan demi pembangunan dan penegakan hukum yang lebih objektif, jujur, dan tidak berpihak.

Penelitian yang digunakan adalah penelitian hukum normatif deskriptif. Kesimpulannya berdasarkan kasus Perjanjian Supply Agreement 2007 antara PT. Dexa Medica bersama dengan Pfizer Overseas Llc (d/h Pfizer Overseas Inc) atas pelaksanaan Paten zat aktif Amlodipine Besylate dan Pasal 31 huruf k TRIPs Agreement yang diratifikasi dengan Undang-Undang Nomor 7 Tahun 1994 tentang Pengesahan Agreement Establishing The World Trade Organization (Persetujuan Pembentukan Organisasi Perdagangan Dunia) pada Lampiran 25 serta Pasal 14 Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 30 Tahun 2019 perlu ditindaklanjuti dengan penggunaan Lisensi Wajib Paten yang diberikan untuk memperbaiki praktik persaingan usaha tidak sehat, maka perlu dilakukan peninjauan kembali pengecualian perjanjian yang berkaitan dengan hak atas kekayaan intelektual seperti lisensi dan paten dari Pasal 50 Undang-Undang Nomor 5 Tahun 1999. Sehingga pelaksanaan Paten dan lisensinya yang diduga mengakibatkan praktik monopoli dan atau persaingan usaha tidak sehat dapat menjadi objek pengawasan dan putusan Komisi Pengawas Persaingan Usaha (KPPU).

Abstract:
Penelitian ini bertujuan untuk menganalisis mengenai pengadaan tanah untuk pembangunan demi kepentingan umum di Indonesia berdasarkan Pancasila. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian normatif yakni penelitian hukum yang dilakukan dengan cara mengkaji peraturan perundang-undangan yang diterapkan terhadap suatu permasalahan hukum tertentu. Hasil penelitian ini menyatakan bahwa pengadaan tanah untuk pembangunan demi kepentingan umum yang berdasarkan Pancasila adalah dengan menjungjung tinggi asas-asas dasar diantaranya kemanusiaan dan keadilan. Selain itu, pemberian ganti rugi akibat pengadaan tanah harus dilakukan berdasarkan musyawarah untuk mufakat demi terciptanya keadilan berdasarkan Pancasila sehingga tidak menimbulkan kerugian bagi pihak-pihak yang kehilangan hak atas tanahnya.

Penelitian ini bertujuan untuk mengetahui Penerapan Keadilan Restoratif (Restorative Justice) Dalam Kasus Persetubuhan Terhadap Anak (Putusan Nomor : 31/Pid.Sus/2018/PN.Lbto dan Hambatan-Hambatan Penerapan Retorative Justice Dalam Perkara Nomor 31/Pid.Sus/2018/PN Lbto. Jenis penelitian yang digunakan dalam kajian ini adalah metode penelitian normatif empiris merupakan penggabungan antara pendekatan hukum normatif dengan adanya penambahan berbagai unsur empiris. Hasil penelitian menunjukan bahwa konsep keadilan restorative justice sudah seharusnya dapat diterapkan dalam putusan hakim Nomor : 31/Pid.Sus/2018/PN.Lbto karena terdakwa dalam hal ini mau untuk bertanggung jawab untuk menikahi korban dan korbanpun dalam hal ini tidak dirugikan. Kemudian dari sisi hambatan yang dialami yaitu hambatan dari segi social dan hambatan dari segi politik hokum pidana di Indonesia.

Abstract:
Penelitian ini bertujuan untuk menganalisis penegakan hukuman mati terhadap pembunuhan berencana dan mengkaji faktor-faktor penghambat dari penegakan hukuman mati terhadap pelaku pembunuhan berencana. Metode penelitian yang digunakan dalam penelitian ini adalah tipe penelitian hukum normatif/doktrinal (normative legal research) yaitu tipe penelitian yang dilakukan dengan cara mengkaji peraturan perundang-undangan yang diterapkan terhadap suatu permasalahan hukum tertentu. Hasil penelitian ini menyatakan bahwa penegakan hukuman mati haruslah diberlakukan terhadap pembunuhan berencana karena, penerapan hukuman mati tidaklah bertentangan dengan Hak Asasi Manusia yang banyak dipersoalkan selama ini, sedangkan faktor-faktor yang menjadi penghambat dilaksanakan eksekusi mati tersebut antara lain: dari aspek yuridisnya, Kebijakan Pemerintah, dan Lemahnya koordinasi antara penegak hukum. Adapun saran yang diberikan kepada pembuat undang-undang agar melakukan pembaharuan terhadap KUHP terkhusus lagi mengenai Pasal tentang Pembunuhan Berencana, agar sebaiknya dicantumkan dalam pasal ataupun penjelasan tersebut tentang kualitas dan kuantitas yang didasarkan pada alternatif hukuman yang diberikan. Selanjutnya merekomendasikan mengenai batasan dan waktu dalam hal pengajuan remisi dan grasi terhadap hak terpidana mati yang melakukan kejahatan pembunuhan berencana karena hal tersebut dapat menjadi celah bagi para terpidana.

Independensi Hakim sebagai pelaksana kekuasaan kehakiman merupakan instrumentarium hukum bagi hakim dalam melaksanakan fungsinya mengadili dan memutus suatu perkara yang dihadapkan kepadanya agar terbebas dari segala interfensi dan atau pengaruh dari lingkungan kekuasaan lainnya baik itu dari lingkungan organ kekuasaan eksekutif maupun dari lingkungan organ kekuasaan legislatif. Bahkan terbebas dari tekanan dari unsur-unsur kelompok pengekang dari masyarakat, Ormas-Ormas, LSM, media sekalipun. Independensi Hakim dalam mengadili dan memutus suatu perkara melalui peradilan-peradilan negara telah dijamin dalam UUD NRI Tahun 1945 dan Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman, dengan tujuan agar Hakim dalam menjalankan fungsi yudisialnya benar-benar dapat mengadili dan memutus perkara berdasarkan hukum dan keadilan.

Abstract:
Penelitian ini bertujuan untuk mengkaji hubungan antara DPRD dengan Kepala Daerah dalam mengelola sumber-sumber Pendapatan Asli Daerah (PAD) berdasarkan UU No. 23 Tahun 2014 Tentang Pemerintahan Daerah (UU Pemerintahan Daerah). Penelitian ini menggunakan metode penelitian hukum normatif yang biasa pula disebut dengan penelitian hukum doktrinal. Adapun kesimpulan dari penelitian ini ialah: 1) Kepala Daerah harus melakukan pengelolaan keuangan daerah dengan baik sebagai konsekwensi dari Otonomi Daerah; 2) PAD merupakan salah satu faktor yang paling penting dalam meningkatkan kapasitas fiskal daerah; dan 3) Hubungan antara DPRD dengan Kepala Daerah merupakan kemutlakan dalam menghadirkan kebijakan daerah yang berdampak pada peningkatan PAD.
