Abstract
随着“一带一路”倡议的推进,沿线国之间产生的纠纷越发凸显,中国国际商事法庭为了解决“一带一路”沿线国投资争议应运而生。其“一站式”的纠纷解决机制借鉴了新加坡国际商事法庭的模式,也具有中国自己的独创性。本文通过对中国国际商事法庭的机构设置,规制法条的优势和弊端的分析,探讨真正适合“一带一路”的多元化争端解决机制的设立和中国国际商事法庭目前的路径选择问题。 With the advancement of the “Belt and Road” initiative, disputes between countries along the route have become more prominent, and the China International Commercial Court has emerged to resolve investment disputes in countries along the “Belt and Road”. The “one-stop” dispute settlement draws on the model of the Singapore International Commercial Court, and it also has China’s own originality. This article explores the establishment of a diversified dispute settlement mechanism that is truly suitable for the “Belt and Road” and the current path selection of the China International Commercial Court through the analysis of the institutional setting of the China International Commercial Court and the advantages and disadvantages of its regulations.
