Zur Leistungsfähigkeit der Gewaltenteilung in der BVT-Affäre

Abstract
In 2018, a house search ordered by the public prosecutor at the Federal Office for the Protection of the Constitution and Counterterrorism shocked the Austrian intelligence and security landscape. A parliamentary committee of inquiry was set up and led to allegations of the initiation of the prosecution by the political level of the Federal Ministry of the Interior. The following article analyses the events from a constitutional perspective, especially regarding the efficiency of the separation of powers, and considers the further development of checks & balances both in constitutional law and within the security architecture in Austria.
