تخصیص العام بمذهب الصحابی وأثره الفقهی

Abstract

النص العام قد يرد ، ويوجد له مخصص وهذا المخصص منها ما هو متفق عليه ، ومنها ما هو مختلف فيه ،ومما اختلف فيه التخصيص بمذهب الصحابي، وتم بحث هذه المسألة والتي تعد من المسائل الشائکة عند الأصوليين اعتمد في بحثها على منهج الاستقراء والتحليل وقد قسم البحث إلى تمهيد في التعريفات وثلاثة مباحث ،الأول في أحوال التخصيص بمذهب الصحابي ،والثاني في تحقيق المسألة وذکر أقوال الأصوليين وأدلتهم والراجح منها، وسبب الخلاف فيها، وختم بالثالث في الأثر الفقهي. ثم انتهى البحث إلى توصيات من أهمها: تحقيق مذهب الإمام الشافعي في هذه المسألة. وکذلک حصر القواعد الأصولية التي تنبني على مسألة حجية قول الصحابي. عام، تخصيص، مذهب الصحابي، أحوال، الاثر الفقهي لمذهب الصحابي. The general text may be contained while it has a specific context. These specific contexts include those of agreed upon and those of disagreed upon. One of the specific contexts that is disagreed upon is the companion's school of thought. This issue, which is a thorny issue among the fundamentalists, has been discussed and has been based on the approach of induction and analysis. The research was divided into a preamble on definitions and three theses. The first thesis is the cases of specification according to the companion's school of thought; the second thesis is examining the issue and state the sayings, evidences, the prevailing views and its reasons for disagreement among the fundamentalists; the third thesis is addressing the jurisprudential result. The research concluded some recommendations the most important of them: examining the Imam Shafi's school of thought (Madhhab Imam Shafi) in this issue. It also limits the fundamentalist rules that are based on the authenticity and legitimacy of the companion's school of thought.
